Will Justice Sotomayor Recuse on the Mandate Cases?

If Supreme Court Justice Sotomayor reads the New York Times and watches CNN, then we clearly understand how her alleged knowledge of all things vaccines and mandates are so wrong and exaggerated. This Judge made statements during oral arguments that were wildly wrong. Yeesh. The Justices do gather after arguments are presented and confab on the cases and then collaborate with their clerks. We can only hope Sotomayor gets the memo on how wrong she is or she must recuse from the case(s) dealing with OSHA, vaccines and mandates.

If the Supreme Court rules on the side of the Federal government then the power of the government over all citizens is limitless and tyranny is in stone.

Brian Fletcher, U.S. Principal Deputy Solicitor General, representing the federal government in Biden v. Missouri, told justices that the Centers for Medicare & Medicaid Services and U.S. Secretary of Health and Human Services Xavier Becerra should be allowed to keep the mandate. Challengers, however, noted that the rule forces a medical procedure on healthcare workers who could leave the workforce, and leave rural and poor populations in need of care vulnerable.

“Exercising this kind of power to force the individual to submit to a medical treatment has never ever been something that has been authorized by Congress or done by an agency on an emergency basis,” Louisiana Solicitor General Elizabeth Murrill said. “But I don’t think in this case that justifies them co-opting a quintessential state police power. In fact, the opposite is true.”

Justices Clarence Thomas, Samuel Alito, Amy Coney Barrett, and Neil Gorsuch all seemed skeptical of the vaccine mandate on the grounds that the federal government was extending its reach into state issues. In his questioning, Gorsuch emphasized that the mandate seems less effective as a health and safety protocol and is more of an issue of control.

“Could CMS also implement regulations about exercise regimes?” Gorsuch asked, wondering if “substances that must be ingested by hospital employees” could be implemented “in the name of health and safety?”

Part of this control, Gorsuch hinted, is coming via funding threats.

“These statutes sometimes constitute, we’re told, 10 percent of all the funding state governments receive. This regulation affects, we’re told, 10 million healthcare workers and will cost over a billion dollars for employers to comply with. So what’s your reaction to that? Why isn’t this a regulation that effectively controls the employment and tenure of healthcare workers at hospitals, an issue Congress said the agency didn’t have the authority, that that should be left to the states to regulate?” Gorsuch asked.

In response, Sotomayor asserted her belief that “if you want my money your facility has to do this.”

“This is not an issue of power between the states and federal government. This is an issue of what right does the federal government [have] to dictate what it wants to buy,” Sotomayor said.

“Your Honor, it is a vaccine requirement masquerading as a condition of participation,” Jesus Osete, Missouri Deputy Attorney General, replied.

During the arguments, Justice Elena Kagan, Justice Stephen Breyer, and the counsel arguing in favor of the mandate continued to spew misinformation about COVID-19 and the effectiveness of COVID-19 vaccines. Kagan repeatedly lied that vaccinated workers couldn’t transmit the virus despite numerous admissions from the Centers for Disease Control and Prevention that the jab doesn’t stop viral spread and data showing a significant number of breakthrough COVID cases.

“All the Secretary is doing here is to say to providers, you know what? Basically, the one thing you can’t do is to kill your patients. So you have to get vaccinated so that you’re not transmitting the disease that can kill elderly Medicare patients, that can kill sick Medicaid patients,” Kagan said. “I mean, that seems like a pretty basic infection prevention measure. You can’t be the carrier of disease.”

She later claimed, without evidence, that “people are not showing up to hospitals because they’re afraid of getting COVID from staff.”

Breyer, who used rising COVID-19 case numbers to justify his support for the Biden administration’s vaccine mandate for the private sector, also lied about the shot and COVID hospitalizations.

“There are 750,000 people got this yesterday, but the hospitals are full to overflowing, that there is a problem worse than diptheria,” Breyer said. “They’re filling up hospital beds and others are dying because they can’t get in. Okay. Now public interest, call it something else, call it what you might, but it seems to me, it’s hard for me to believe, but it seems to me that every minute that these things are not in effect, thousands of more people are getting this disease. And we have some discretionary power.”

 

FBI Whistleblower Exposes Terror Tags on Parents EDUOFFICIALS

Garland testified on October 21 that the Justice Department and its components were not using counterterrorism tactics to target ‘concerned parents at school board meetings’ but Republicans say they have documentation that shows differently.

McCarthy also blasted Biden for going after parents instead of ‘actual threats.’

‘This is further proof that we have a President in the White House who is more interested in going after our own citizens, including concerned parents, than he is in going after actual threats. This raises the question that should alarm every American: if the Biden administration is using our country’s top law enforcement agency to go after parents, what are the actual threats they are ignoring?,’ he said.

The House GOP leader was responding to the revelation the Federal Bureau of Investigation has created a ‘threat tag’ to flag all investigations into potentially criminal threats, harassment and intimidation of educators.

Republicans argue this could be used to target parents protesting local education policies. Parents have taken to going to school board meetings to express concern about the teaching of critical race theory, transgender policies and other issues.

The latest revelations came from an FBI whistleblower, who provided an email dated October 20 to House Republicans sent on behalf of the counter-terrorism division and the criminal division.

The email referenced Garland’s October 4 directive to the FBI to ramp up its involvement in school board threats, and notified agents of a new tag, ‘EDUOFFICIALS,’ to assign to any threats against school administrators, board members, staff or teachers to determine the scope of the problem on a national level and to provide a ‘comprehensive analysis of the threat picture.’

Republicans slammed the move.

‘This disclosure provides specific evidence that federal law enforcement operationalized counterterrorism tools at the behest of a left-wing special interest group against concerned parents,’ House Republicans claimed in a letter to Garland.

The email directed agents to analyze the motivation behind the criminal activity and to identify whether there were potential federal violations that could be investigated and charged.

“Not only has America’s education bureaucracy declared war on parents concerned about local schools—but so has the Department of Justice, which has weaponized the FBI against parents to chill their speech,” Neily claimed in a statement. “The American people deserve a full accounting of exactly who was involved, and when—so that egregious overreach like this may be prevented in the future.”

The FBI’s “Counterterrorism and Criminal Divisions created a threat tag, EDUOFFICIALS, to track instances of related threats,” according to the email. “The purpose of the threat tag is to help scope this threat on a national level and provide an opportunity for comprehensive analysis of the threat picture for effective engagement with law enforcement.”

The email was signed by Counterterrorism Division assistant director Timothy Langan, and former Criminal Division assistant director Calvin Shivers, who retired earlier this month. source

Although SROs may give parents some sense of comfort that their children are protected while at school, students actually face certain perils because of constant police presence. The well-traveled school-to-prison pipeline has been documented by research in terms of greater reliance on the justice system in response to student infractions, especially for minority youngsters.

If children are not punished in some form with violence and criminal activity it adds to the already broken juvenile justice system.

SHREVEPORT, La. — A group of fathers in Shreveport are taking safety into their own hands after repeated violence broke out in one school, where 23 students were arrested over a short three-day period. “Dads on Duty” showed up and the daily brawls suddenly came to an end.

One of the father’s, Michael LaFitte, launched a group called “Dads on Duty.” It ignited a desire in 40 fathers to sign up and take shifts at Southwood High School in Shreveport. Their goal is to simply maintain a peaceful environment, and thus far, it’s been profoundly successful, CBS News reported.

Although none of the fathers have a “pedigree” of expertise, i.e. degrees in school counseling or criminal justice, they do have some relevant experience, namely concerned parents who have a shared, invested interest in a safe learning environment for their kids.

“We’re dads. We decided the best people who can take care of our kids are who? Are us,” LaFitte told the news outlet.


School violence increased last month, when ongoing fights resulted in 23 teen arrests over three days. Sept. 16 was an extremely violent day, which led to 14 arrests after two major fights erupted, requiring the school’s resource officer to call for backup officers to respond, Fox reported.

“We had a fight at 9:30,” Caddo Parish Sheriff Steve Prator said at the time, according to KSLA. “I believe that there were seven kids that were. I call them kids, that sounds innocent. Seven of these thugs were expelled or sent home.”

However, since “Dads on Duty” was launched and deployed, there have been no instances of violence. Moreover, some students said their presence has helped the environment at the school, CBS reported.


“I immediately felt a form of safety,” one of the students said. “We stopped fighting; people started going to class.”

“You ever heard of ‘a look?’” one student asked while describing a “power” the student said all fathers have.

Furthermore, students say the fathers bring a sense of security as they crack “dad jokes” while interacting with teens in the hallways.

“They just make funny jokes like, ‘Oh, hey, your shoe is untied,’ but it’s really not untied,” one student told CBS.

“The school has just been happy — and you can feel it,” another student said.

As teen violence has also increased in other locales, the fathers said they will keep with the program indefinitely and would like to start chapters throughout Louisiana and even the country.

“Because not everybody has a father figure at home – or a male, period, in their life. So just to be here makes a big difference,” the group of dads said.

Saule Omarova, President Biden’s pick to be the comptroller of the currency within the Treasury Department, appears to have joined a Facebook group for Marxist and socialist discussion in 2019, according to a post in the group called “Marxist Analysis and Policy.”

This week, the right-leaning American Accountability Foundation first resurfaced a 2019 post from the public Facebook group. A member posted, “Let’s welcome our newest members: Saule Omarova.”

The post links to a Facebook account that’s been in operation since at least 2017 with a profile picture that appears to be of Omarova. The account’s profile picture has 85 visible likes and 14 visible comments, some of which appear to be from people who would reasonably run in the same social circles as Omarova. Those include a University of Minnesota law professor and a Cornell engineering professor.

The White House announced that it is nominating Omarova – a Cornell law professor – to run the key post that regulates national banks last month. Since then, Omarova has drawn harsh scrutiny for her past comments that were very hostile toward the financial services industry. She’s also been attacked over her Moscow State University thesis about Marxism, which Sen. Pat Toomey, R-Pa., is demanding that she turn over to the Banking Committee.

FOX Business sent messages to both Omarova and the White House requesting confirmation that the Facebook account is authentic, and asking for comment. Neither responded.

The Facebook group’s description states that it is for socialism and against capitalism.

“This Marxist group is a platform for analysis, policy (sic) and polemics from the perspectives of a diverse range of Socialist and anti-capitalist views,” it says. “We are against exploitation, inequality, racial (sic) discrimination and ecological destruction at the core of Capitalist social relations. The working class has the potential and the ability to change Capitalism and in the process change itself. Only working people, by (sic) their own efforts, can free themselves from Capitalism. We stand for the self emancipation of the working class and Socialism.”

The group’s rules say, “No personal abuse will be allowed. Nor will racist or fascist comments be tolerated. Support for the Tory party is not acceptable. A culture of diverse Marxist, Socialist and radical views is the framework for the group.”

The posts in the group appear to indicate that it is a forum for serious ideological discussion, and not a parody forum. A post in the group from Oct. 19 promotes a lecture by a Dublin City University professor about “A Marxist Narrative, From Marx and Engels to COVID-19.”

Older posts include the “ACAB” (All Cops are Bastards) slogan, and celebrate the 2020 Seattle autonomous zone protest as at the center of the battle for socialism.

“Seattle emerged once again as the center of anti-capitalist mobilizations,” one poster wrote. “The protestors occupied 6 blocks, and declared them to be police-free areas. They operate like a ‘soviet’ with many radical anti-police, and anti-capitalist speeches.”

The poster added: “The radicalization of the youth and young workers in Seattle is very important. It shows a way for the protests in the rest of the country. This is one of these times that the masses radicalize very fast, and they are open for revolutionary socialist alternatives to the decaying capitalism.” More here

DOJ Considering Parents vs. School Boards as Terrorists

The National School Boards Association wrote a 6 page letter to President Biden. The full letter is here. In part:

As these threats and acts of violence have become more prevalent during public
school board meetings, via documented threats transmitted through the U.S. Postal Service, through
social media and other online platforms, and around personal properties NSBA respectfully asks
that a joint collaboration among federal law enforcement agencies, state and local law enforcement,
and with public school officials be undertaken to focus on these threats. NSBA specifically solicits
the expertise and resources of the U.S. Department of Justice, Federal Bureau of Investigation (FBI),
U.S. Department of Homeland Security, U.S. Secret Service, and its National Threat Assessment
Center regarding the level of risk to public schoolchildren, educators, board members, and
facilities/campuses. We also request the assistance of the U.S. Postal Inspection Service to intervene
against threatening letters and cyberbullying attacks that have been transmitted to students, school
board members, district administrators, and other educators.


As these acts of malice, violence, and threats against public school officials have increased, the
classification of these heinous actions could be the equivalent to a form of domestic terrorism and
hate crimes. As such, NSBA requests a joint expedited review by the U.S. Departments of Justice,
Education, and Homeland Security, along with the appropriate training, coordination,
investigations, and enforcement mechanisms from the FBI, including any technical assistance
necessary from, and state and local coordination with, its National Security Branch and
Counterterrorism Division, as well as any other federal agency with relevant jurisdictional authority
and oversight. Additionally, NSBA requests that such review examine appropriate enforceable
actions against these crimes and acts of violence under the GunFree School Zones Act, the
PATRIOT Act in regards to domestic terrorism, the Matthew Shepard and James Byrd Jr. Hate
Crimes Prevention Act, the Violent Interference with Federally Protected Rights statute, the
Conspiracy Against Rights statute, an Executive Order to enforce all applicable federal laws for the

These threats or actual acts of violence against our school districts are impacting the delivery of
educational services to students and families, as many districts receive federal funds and subsidies
for services to millions of students with disabilities, health screenings and supplemental supports for
disadvantaged students, child nutrition, broadband connectivity, educator development, school
safety activities, career and technical education, and more. School board meetings have been
disrupted in California, Florida, Georgia, and other states because of local directives for mask
coverings to protect students and educators from COVID19.


An individual was arrested in Illinois for aggravated battery and disorderly conduct during a school
board meeting. During two separate school board meetings in Michigan9, an individual yelled a
Nazi salute in protest to masking requirements, and another individual prompted the board to call

a recess because of opposition to critical race theory.

Terry McAuliffe and Glenn Youngkin sparred during the second and final debate of Virginia’s governor’s race on Tuesday, but it was one comment on schools by McAuliffe, the Democratic candidate, that drew the ire of conservatives. 

“I don’t think parents should be telling schools what they should teach,” McAuliffe, who previously served as governor of Virginia from 2014 to 2018, said during the debate in Alexandria, Virginia.

McAuliffe made the remarks in response to Youngkin, the Republican candidate, who argued that parents should be more involved in the decisions of local school districts. Conservative social media responded. 

Just how long before the public school systems across the country collapse and homeowners challenge in court their property tax dollars that pay for the public school systems and teachers? The Biden administration is fully devoted to unions and will continue to side with the teacher’s unions as has already been proven with regard to financial bailouts and masks mandates.

Take caution parents, this is a tailspin that has no end until the parents declare an end to the entire corrupt system.
