This is significant as these are Federal charges and not under the authority of liberal District Attorneys. However, there is movement by the Portland Police.

Portland police are cracking down on nightly demonstrations and ramping up enforcement since federal forces scaled back their presence in downtown.

City officers have made 217 arrests at protests since Aug. 1, nearly three times the 77 they made in all of July, according figures released by the Portland Police Bureau and reviewed by The Oregonian/OregonLive.

About half of those occurred in the last week, when police declared riots five out of seven nights. Officers arrested more than 20 people on each of three of those nights. More here.

74 People Facing Federal Charges for Crimes Committed During Portland Demonstrations

Charges include assaulting federal officers, arson, failing to obey lawful orders, and damaging federal property

U.S. Attorney Billy J. Williams announced today that 74 people are facing federal charges for crimes committed adjacent to or under the guise of peaceful demonstrations in Portland since at least May 29, 2020.

For more than 90 consecutive nights, Portland has been home to large demonstrations and protests against police use of force and anti-Black racism. On many nights, after peaceful demonstrations end, various public and private buildings have been the target of vandalism and destruction. Local, state, and federal law enforcement working to protect these buildings and ensure the safety of peaceful demonstrators have been subjected to threats and assaults from violent agitators while performing their duties.

“Violent agitators have hijacked any semblance of First Amendment protected activity, engaging in violent criminal acts and destruction of public safety,” said U.S. Attorney Williams. “The U.S. Attorney’s Office and our federal law enforcement partners are expeditiously working with local and state law enforcement to identify, arrest, and prosecute these individuals that are disrupting the rule of law in our communities and physically attacking our law enforcement officers and destroying property. Violent agitators not only delay real reform, but make our community less safe by keeping law enforcement from responding to other critical calls for service.”

“While the FBI supports and safeguards Constitutionally-protected activity and civil rights, there is no permit for assault, arson or property damage and these are not victimless crimes,” said Renn Cannon, Special Agent in Charge of the FBI in Oregon. “Among the victims of violent crime are business owners, residents and individuals exercising their First Amendment rights through protests or other legitimate forms of expression.”

“The nightly violence has to stop,” said Russel Burger, U.S. Marshal for the District of Oregon. “It is drowning out the voices of the many who are calling for change, and pulling police resources away from their primary mission of keeping this community safe. We must all come together to find a productive way to move forward.”

“As the nation’s primary source for fire investigative knowledge, ATF remains committed to investigating those responsible for committing arsons in our communities and holding them responsible for their illegal actions,” said ATF Special Agent in Charge Jonathan McPherson. “As a reminder, there is a mandatory minimum sentence of five years for arson. ATF takes these violent actions seriously and will work diligently to bring justice to the victims.”

“It is vitally important that all Americans have the ability to exercise their first amendment rights to freedom of speech,” said Acting Special Agent in Charge of Homeland Security Investigations Seattle Eben Roberts. “Unfortunately, much of what we’re seeing in Portland is the antithesis of that. Instead tragic events are being used as excuses for individuals with ill intent disguising themselves as activists to commit violent crimes against their communities and law enforcement officers. Progress can only be made if community leaders, law enforcement and the public come together in the name of social change, justice and peace.”

Since May 26, 2020, federal law enforcement authorities have arrested 100 people for crimes committed during local demonstrations. Seventy-four face federal charges, including felonies, misdemeanors, and citation violations. Crimes include assaults on federal officers, some resulting in serious injuries; arson and attempted arson; damaging federal government property; failing to obey lawful orders; and unlawful use of a drone; among others.

Eleven others have been issued citation violations. All defendants, unless noted, are presumed to be local residents.

Several of the charges being used to prosecute violent agitators carry significant maximum prison sentences. For example, felony assault of a federal officer with a dangerous weapon is punishable by up to 20 years in prison. Arson is punishable by up to 20 years in prison with a mandatory minimum sentence of five years.

It is important to note that while some federal charges require crimes be committed on federal property, others do not. Violent acts committed throughout the city of Portland under the guise of peaceful protest are being evaluated by local federal prosecutors for prosecution.

These cases are being investigated by the FBI; U.S. Marshals Service; Bureau of Alcohol, Tobacco, Firearms, and Explosives; U.S. Immigration and Customs Enforcement’s Homeland Security Investigations; and Federal Protective Service. They are being prosecuted by the U.S. Attorney’s Office for the District of Oregon.

Indictments, complaints, and informations are only accusations of a crime, and defendants are presumed innocent unless and until proven guilty.

To help identify actors who are actively instigating violence in the city of Portland, the FBI is accepting tips and digital media depicting violent encounters during demonstrations. If you have witnessed unlawful violent actions, we urge you to submit any information, photos, or videos that could be relevant to investigations at fbi.gov/PDViolence.

Specifically, the FBI is assisting partner agencies by asking for the public’s help in identifying individuals who participated in or may have been a witness to criminal activity at the following locations:

Dstl has been supporting the COVID19 response since February through lab based research and testing, and deployment of scientific staff across Government. From working in partnership with Public Health England (PHE) and the National Health Service (NHS) to studying how the virus behaves, Dstl scientists are playing a vital role in the Government’s coronavirus response. New Calls for Democracy in Venezuela

As Venezuelan President Nicolas Maduro on Sunday thanked ally Iran for helping the South American country overcome U.S. sanctions on its oil industry and floated the idea of purchasing missiles from the country.

Washington maintains strict sanctions against Iran’s oil industry to try to halt the country’s nuclear program. Earlier this year, Tehran sent several gasoline cargoes to Venezuela to help it overcome fuel shortages, as well as equipment to help state oil company PDVSA repair its dilapidated refineries.

Thirty-three countries from around the globe, including members of the Lima Group and the International Contact Group and some European Union member states, signed a joint declaration calling for democracy in Venezuela.

The declaration, released August 14, is a call “to put the interests of Venezuela above politics and engage urgently in support of a process shaped and driven by Venezuelans to establish an inclusive transitional government that will lead the country into free and fair presidential elections, sooner not later,” it says.

Its call for an inclusive transitional government reinforces proposals made by the Venezuelan Interim Government and the U.S. government’s proposed Democratic Transition Framework, released in March.

The framework calls for a transitional government to function as a temporary executive branch. This transitional government would oversee steps leading to a truly free presidential election, ensuring that no candidate has an unfair advantage, and set the country on a path to recovery.

The proposed framework won’t be “a way for Maduro to stay in power in perpetuity, which is what he’s looking for, but it’s a way for everybody around him to say, ‘Actually, we have a pretty good future if we just take it,’” said the State Department’s Michael Kozak at a press availability August 14.

The declaration was signed by a coalition of countries around the world. As of August 19, these countries had signed: Albania, Australia, The Bahamas, Bolivia, Brazil, Canada, Chile, Colombia, Costa Rica, Czech Republic, Dominican Republic, Ecuador, El Salvador, Estonia, Georgia, Guatemala, Guyana, Haiti, Honduras, Hungary, Israel, Republic of Korea, Kosovo, Latvia, Lithuania, Morocco, Panama, Paraguay, Peru, Saint Lucia, Ukraine, United Kingdom, and United States.

The declaration calls for all political persecution and acts of repression to end, especially those committed against:

“It is time for a peaceful, democratic transition in Venezuela,” said Secretary of State Michael R. Pompeo on August 14. “The United States and the international community share an obligation to demonstrate and provide support for the Venezuelan people as they strive to reclaim their democracy.”

The US State Department Framework for a Democratic Transition for Venezuela

  1. Full return of all members of the National Assembly (AN); Supreme Court (TSJ) lifts order of contempt and restores all powers to the AN, including immunities for deputies; National Constituent Assembly (ANC) is dissolved. The U.S. lifts sanctions imposed on ANC members due to their membership in the ANC.
  2. All political prisoners are released immediately.
  3. All foreign security forces depart immediately unless authorized by 3/4 vote of the AN.
  4. AN elects new National Electoral Council (CNE) and TSJ members who are acceptable to all parties or coalitions of parties representing 25% or more of AN membership. (This would give both the PSUV and the multi-party Guaidó coalition a veto over personnel for any of these posts.) Upon the selection of a new CNE and TSJ, the U.S. lifts sanctions imposed on former CNE and TSJ members due to their membership in those bodies.
  5. AN approves “Council of State” Law, which creates a Council of State that becomes the executive branch. Each party or coalition of parties with 25% or more of AN membership selects two members of the Council of State, one of whom must be a state governor. The four members of the Council of State then select a fifth member, to be Secretary General, and who serves as Interim President until the elections and is not permitted to be a candidate for president in the elections.  Council members may not be members of the AN or TSJ. Decisions of the Council of State will be reached by majority vote. One member of the National Armed Forces of Venezuela (FANB) will serve as Military Adviser to the Council of State.
  6. All of the powers assigned to the President by the Constitution will be vested exclusively in the Council of State. The U.S. and the EU will lift sanctions on those who claimed Presidential authorities which were imposed due to their holding their previous positions once the Council of State is functioning and those individuals renounce any further claims to hold executive positions and acknowledge the Council of State as the exclusive executive power.
  7. Once the Council of State is established and foreign security forces have departed (unless approved by 3/4 vote at the AN), U.S. sanctions on the Government of Venezuela, PDVSA, and the oil sector are suspended.
  8. Council of State appoints new cabinet. The U.S. lifts sanctions on former cabinet members due to their holding their previous positions. The U.S. also lifts sanctions on members of the FANB that are based on their position in the institution.
  9. The international community provides humanitarian, electoral, governance, development, security, and economic support, with special initial focus on medical care system, water and electricity supply. Existing social welfare programs, now to be supplemented with international support, must become equally accessible to all Venezuelan citizens. Negotiations begin with World Bank, IMF, and Inter-American Development Bank for major programs of support.
  10. A Truth and Reconciliation Commission is established with the task of investigating serious acts of violence that occurred since 1999, and reports to the nation on the responsibilities of perpetrators and the rehabilitation of victims and their families. The Commission has five members, who are selected by the Secretary General of the United Nations with the consent of the Council of State. The AN adopts amnesty law consistent with Venezuela’s international obligations, covering politically motivated crimes since 1999 except for crimes against humanity. Argentina, Canada, Colombia, Chile, Paraguay, and Peru withdraw support for the International Criminal Court referral.
  11. The Council of State sets a date for simultaneous Presidential and AN elections in 6-12 months. Any Venezuelan citizen eligible in accordance with the 1999 Constitution can compete in the election.
  12. Presidential and AN elections are held. With a consensus of international observers that elections were free and fair, remaining U.S. sanctions are lifted.
  13. Bi-partisan commission within the AN is developed to create long term solutions to rehabilitating the economy and refinancing the debt.

Guarantees

  1. The military high command (Defense Minister, Vice Defense Minister, CEOFANB Commander, and Service Chiefs) remains in place for the duration of the transitional government.
  2. State or local authorities remain in place for the duration of the transitional period.

Trump will arrive in Charlotte on Marine One, the presidential helicopter, at 11:45 a.m. ET on Monday, according to the White House. His movements in the city have not been announced.

Later, Trump travels to the small town of Mills River to deliver remarks at Flavor 1st Growers & Packers, an owner-operated farm and repacking facility. He will arrive at Asheville Regional Airport in Fletcher at 2:20 p.m. ET and speak about an hour later.

Trump is expected to accept the Republican nomination at the White House on Thursday. Other speeches will be held around Washington and at Fort McHenry in Baltimore, where the 1812 battle that inspired the “Star Spangled Banner” occurred.

The Trump campaign has announced the list of RNC speakers for the event next week.

Some surprise names include Georgia State Rep. Vernon Jones, who is a Democrat, and UFC executive Dana White.

    The Wall Street Journal reported this week that Bannon and exiled Chinese businessman Guo Wengui “have been spending significant time together on Mr. Guo’s yacht.” The two men have been linked to GTV Media Group, a private company under federal investigation.

Bartlett, Inspector-in-Charge of the New York Field Office of the United States Postal Inspection Service (“USPIS”), announced the unsealing of an indictment charging BRIAN KOLFAGE, STEPHEN BANNON, ANDREW BADOLATO, and TIMOTHY SHEA for their roles in defrauding hundreds of thousands of donors in connection with an online crowdfunding campaign known as “We Build the Wall” that raised more than $25 million.  The defendants were arrested this morning.  KOLFAGE will be presented today before U.S. Magistrate Judge Hope T. Cannon in the Northern District of Florida.  BANNON will be presented today in the Southern District of New York.  BADOLATO will be presented today before U.S. Magistrate Judge Thomas Wilson in the Middle District of Florida.  SHEA will be presented today before U.S. Magistrate Judge Kristen L. Mix in the District of Colorado.  The case is assigned to U.S. District Judge Analisa Torres in the Southern District of New York.

Acting U.S. Attorney Audrey Strauss said:  “As alleged, the defendants defrauded hundreds of thousands of donors, capitalizing on their interest in funding a border wall to raise millions of dollars, under the false pretense that all of that money would be spent on construction.  While repeatedly assuring donors that Brian Kolfage, the founder and public face of We Build the Wall, would not be paid a cent, the defendants secretly schemed to pass hundreds of thousands of dollars to Kolfage, which he used to fund his lavish lifestyle.  We thank the USPIS for their partnership in investigating this case, and we remain dedicated to rooting out and prosecuting fraud wherever we find it.”

Inspector-in-Charge Philip R. Bartlett said:  “The defendants allegedly engaged in fraud when they misrepresented the true use of donated funds.  As alleged, not only did they lie to donors, they schemed to hide their misappropriation of funds by creating sham invoices and accounts to launder donations and cover up their crimes, showing no regard for the law or the truth.   This case should serve as a warning to other fraudsters that no one is above the law, not even a disabled war veteran or a millionaire political strategist.”

According to the Indictment[1] unsealed today in Manhattan federal court:

Starting in approximately December 2018, BRIAN KOLFAGE, STEPHEN BANNON, ANDREW BADOLATO, and TIMOTHY SHEA, and others, orchestrated a scheme to defraud hundreds of thousands of donors, including donors in the Southern District of New York, in connection with an online crowdfunding campaign ultimately known as “We Build The Wall” that raised more than $25 million to build a wall along the southern border of the United States.  In particular, to induce donors to donate to the campaign, KOLFAGE repeatedly and falsely assured the public that he would “not take a penny in salary or compensation” and that “100% of the funds raised . . . will be used in the execution of our mission and purpose” because, as BANNON publicly stated, “we’re a volunteer organization.”

Those representations were false.  In truth, KOLFAGE, BANNON, BADOLATO, and SHEA received hundreds of thousands of dollars in donor funds from We Build the Wall, which they each used in a manner inconsistent with the organization’s public representations.  In particular, KOLFAGE covertly took for his personal use more than $350,000 in funds that donors had given to We Build the Wall, while BANNON, through a non-profit organization under his control (“Non-Profit-1”), received over $1 million from We Build the Wall, at least some of which BANNON used to cover hundreds of thousands of dollars in BANNON’s personal expenses.  To conceal the payments to KOLFAGE from We Build the Wall, KOLFAGE, BANNON, BADOLATO, and SHEA devised a scheme to route those payments from We Build the Wall to KOLFAGE indirectly through Non-Profit-1 and a shell company under SHEA’s control, among other avenues.  They did so by using fake invoices and sham “vendor” arrangements, among other ways, to ensure, as KOLFAGE noted in a text message to BADOLATO, that his pay arrangement remained “confidential” and kept on a “need to know” basis.

KOLFAGE, 38, of Miramar Beach, Florida, BANNON, 66, of Washington, D.C., BADOLATO, 56, of Sarasota, Florida, and SHEA, 49, of Castle Rock, Colorado, are each charged with one count of conspiracy to commit wire fraud and one count of conspiracy to commit money laundering, each of which carries a maximum penalty of 20 years in prison.

The statutory maximum penalties are prescribed by Congress and are provided here for informational purposes only, as any sentencing of the defendants would be determined by the judge.

Ms. Strauss praised the outstanding investigative work of the USPIS and the Special Agents of the United States Attorney’s Office for the Southern District of New York.  She also thanked the U.S Attorney’s Office for the Northern District of Florida for their assistance.

The case is being handled by the Office’s Public Corruption Unit.  Assistant United States Attorneys Nicolas Roos, Alison G. Moe, and Robert B. Sobelman are in charge of the prosecution.

The charges contained in the Indictment are merely accusations.  The defendants are presumed innocent unless and until proven guilty.
