HAVANA –

Cuban President Raul Castro praised Pope Francis’ critiques of the global economic system, saying it has “globalized capital and turned money into its idol.”

In a lengthy speech welcoming the pope at Havana’s international airport Saturday, Castro said Cuba’s communist government has “founded an equitable society with social justice.”

Here is a translation of Castro’s speech:

Your Holiness,

The people and government of Cuba welcome you with profound affection, respect and hospitality.

We feel particularly honored with your visit. You will see how deeply we love our homeland, for which we are capable of the greatest sacrifices. We have always followed in the steps of the heroes of our America, who bestowed upon us their honor, courage and generosity. It is from them that we have learned to exercise Marti’s axiom that homeland is Humanity.

The memorable meeting we had last May in Vatican City offered an opportunity to exchange ideas on some of the most important issues related to the world we live in.

The peoples of Latin America and the Caribbean have decided to move forward with integration, in defense of our independence, sovereignty over natural resources and social justice.

However, our region still shows the greatest disparity in wealth distribution. In this continent, legitimate governments working for a better future are facing numerous attempts at destabilization.

We have closely followed your statements. The apostolic exhortation known as “The Joy of Gospel” related to social issues, and the encyclical “Praise Be To You” related to the future and care for the planet and humanity, have moved me to a profound reflection. They shall be references for the next Summit on the Post-2015 Development Agenda to be held at the United Nations this month, and the 21st International Conference on Climate Change scheduled for December in Paris.

An increasing global impact has resulted from your analysis on the causes of these problems and the call to safeguard the planet and the survival of our species; to cease the predatory action of the wealthy nations and the big transnationals; and, to remove the dangers threatening us all due to the depletion of resources and the loss of biodiversity.

As his Holiness has rightly indicated: “Humanity should become aware of the necessity to change life styles as well as production and consumption patterns.”

At the UN Conference on Development and the Environment held in Rio de Janeiro in1992, Fidel Castro, leader of the Cuban Revolution, raised the necessity to save humanity from self-destruction; to make a better distribution of wealth, knowledge, science and technology in order to attain a sustainable development; and “to make hunger, and not nan, disappear.”

The current international system is unfair and immoral. It has globalized capital and turned money into its idol. It makes people become simple consumers, and instead of disseminating knowledge and culture, it alienates them with behavior patterns and reflexes promoted by means that serve only their owners’ interests, that is, the transnational media corporations.

The deep and permanent crisis falls harshly on the Third World countries, albeit in the industrial world it also affects the disenfranchised, the minorities, the young unemployed and the helpless elders as well as those seeking refuge from starvation and conflict. What immigrants and the poor are going through stands as an offense to human conscience. They are the outraged of the world claiming for their rights and the end to such injustice.

Your Holiness,

In your remarks to the world meetings of Popular Movements held in October last year at Vatican City and in July this year at Santa Cruz de la Sierra in Bolivia, you reiterated the necessity to practice solidarity and to struggle together against the structural sources of poverty and inequality; for man’s dignity and his right to the land and to work; and for a roof to give him shelter.

It was to conquer such rights, among others, that the Cuban Revolution was undertaken. Those were the same rights that Fidel advocated in the historical defense argument known as “History Will Absolve Me.”

It is to build a society with more justice and solidarity that we have made extraordinary efforts and taken the greatest risks ever since the revolutionary victory.
And, we have done while blockaded, slandered, and attacked; and paying a high toll in human lives and economic damages. We have founded an equitable society with social justice and extensive access to culture, attached to traditions and to the most advanced ideas of Cuba, Latin America, the Caribbean and the world.

Millions of people have recuperated their health thanks to Cuban cooperation: 325,710 collaborators have provided services in 158 countries; today, 50,281 Cuban healthcare workers are providing services in 68 nations; thanks to the “Yes, I Can” educational program, 9,376,000 people have left illiteracy behind in 30 different countries, while more than 68,000 students from 157 countries have graduated in Cuba.

We keep advancing with determination in the updating of our economic and social model to build a prosperous and sustainable socialism focused on human beings and the family, and with the free, democratic, conscious and creative involvement of the entire society, particularly young people.

Preserving socialism is tantamount to securing independence, sovereignty, development and the well being of our nation. We are firmly determined to face every challenge and build a just and virtuous society with high ethical and spiritual values. As the honorable priest Félix Varela indicated, “We want the future generations to inherit from us the dignity of man, and to remember what it takes to recover it so that they fear losing it.”


Regional unity, identity and integration should be defended. The Proclamation of Latin America and the Caribbean as a Peace Zone, signed by heads of state and government at the 2nd Summit of the Community of Latin American and Caribbean States held in Havana in January 2014, establishes a set of commitments of crucial importance such as: the peaceful solution of controversial issues in order to definitely remove the use, and the threat of the use, of force in our region; the prevention of direct or indirect interference in the domestic affairs of any other state and respect for the principles of national sovereignty; the equality of rights and free determination of the peoples; the promotion of friendly relations and cooperation among themselves and with other nations; and, full respect for the inalienable right of every state to choose its political, economic, social and cultural system as an essential premise to ensure peaceful coexistence among nations.

Concerning Cuba, the purposes and principles consecrated in the United Nations Charter are fully valid. Only respect for them can ensure international peace and security, which at the moment are increasingly challenged.

We found extremely interesting his Holiness remarks during the commemoration of the 70th anniversary of the nuclear strikes on the cities of Hiroshima and Nagasaki.

The existence of nuclear weapons threatens the very survival of human beings and constitutes an affront to the ethical and moral principles that should guide relations among nations. The use of such weapons would bring about the obliteration of human civilization; therefore, advocating disarmament, particularly nuclear disarmament, is not only the duty but also the right of all peoples in the world.

Your Holiness,

We have expressed our appreciation for your support to the United States-Cuba dialogue. The reestablishment of relations has been a first step in the process toward normalization of the relationship between the two countries, which will demand resolving problems and correcting injustices. The blockade, which causes human damages and privations to the Cuban family, is cruel, immoral and illegal, and it should cease. The territory usurped by the Guantanamo Naval Base should be returned to Cuba and other issues resolved, too. Such fair claims are shared by the peoples and the overwhelming majority of governments in the world.

This year we are celebrating the 80th anniversary of uninterrupted relations between the Apostolic Holy See and Cuba. These relations are good and continue to favorably develop on the basis of mutual respect.

Relations between the government and the Catholic Church in Cuba are developing in a gratifying atmosphere, the same as with every denomination and religious institution represented in the country that promote moral values recognized and enhanced by our nation. We exercise religious freedom as a right consecrated in our Constitution.

We attach full meaning to the presence of his Holiness in our homeland. We feel that it will be a transcendental and enriching experience for our nation that he meets with our industrious and educated people, our selfless and generous people that treasure profound convictions and patriotic values, and are willing to continue their heroic resistance and build a society capable of ensuring the full development of men and women, with dignity and justice.

On behalf of this noble people I offer you the warmest welcome.

Hammond: We have, of course, talked primarily this morning about the situation in Syria and the migration crisis that is affecting Europe, and we’ve talked about how to move forward with our partners in response to recent developments in Syria to tackle the growing threat from ISIL and to ensure that we’re joined up between our actions in Iraq and our actions in Syria.

Kerry:

With respect to Syria, obviously, we spent a significant amount of time and we covered a lot of territory today. As the foreign secretary said, we talked about Yemen, where we urged the parties to get to negotiations. We talked about Libya, where hope that the work of Bernardino Leon will bear fruit. But obviously, there are challenges, and we call on the house of representatives to return to that process and to recognize this is a critical moment. And ISIL and other extremist groups take advantage of a vacuum, and a vacuum is what is left if there is not an agreement. So we need for the sake of the 6 million citizens of Libya, where there is great opportunity and significant wealth available to be able to help that country bind its wounds and move forward. We hope that they will make the right choices in the days ahead.

With respect to Syria, the foreign secretary and I agreed completely on the urgency of nations coming together in order to resolve this war that has gone on for much too long. And it is clear that the challenge to continental Europe, but to everybody, of the migrant population of refugees seeking a better life cannot be properly addressed just by addressing the numbers of refugees coming into a country or providing more support to them; it has to be addressed by dealing with the root cause, which is the violence in Syria and the lack of hope and possibility of a future that so many people in that region feel as a consequence of the violence that’s taking place.

Only one in every five migrants claiming asylum in Europe is from Syria.

The EU logged 213,000 arrivals in April, May and June but only 44,000 of them were fleeing the Syrian civil war.

Campaigners and left-wing MPs have suggested the vast majority of migrants are from the war-torn state, accusing the Government of doing too little to help them.

‘This exposes the lie peddled in some quarters that vast numbers of those reaching Europe are from Syria,’ said David Davies, Tory MP for Monmouth. ‘Most people who are escaping the war will go to camps in Lebanon or Jordan.

‘Many of those who have opted to risk their lives to come to Europe have done so for economic reasons.’

The figures from Eurostat, the EU’s official statistical agency, show that migration from April to June was running at double the level of the same period in 2014.

The number of Afghans lodging asylum claims is up four-fold, from 6,300 to 27,000. Another 17,700 claims were made by Albanians, whose country is at peace.

A further 13,900 applicants came from Iraq which, like Syria, is being torn apart by the Islamic State terror group.

They are Afghanistan’s latest diaspora, refugees of raging war and shrunken economic prospects, swept up in the largest flood of migrants Europe has seen in more than 70 years.

Until their numbers were eclipsed by refugees from the Syrian war last year, Afghanistan had produced more refugees than any other nation thanks to more than three decades of intractable conflict.

While the majority of prior Afghan refugees made new lives in Pakistan and Iran, United Nations data say nearly 80,000 Afghans are now officially seeking asylum in Europe — the highest rate in 20 years.

Their exodus has only increased as a resurgent Taliban wages its bloodiest offensive in 14 years.

Drawn by the promise of a better life, many tapped into their life’s savings and money from family already in Europe to pay smugglers to spirit them across six countries. The less well-off risked the journey alone.

Secretary of Homeland Security Jeh Johnson has designated the visit of Pope Francis to Philadelphia, Washington D.C. and New York as a National Special Security Event (NSSE) which allows for enhanced cooperation of local, state and federal partners in establishing a safe and secure environment.

The U.S. Secret Service serves as the lead federal law enforcement and coordinating agency for developing and implementing a comprehensive security plan for the Papal Visit. Interagency coordination is critical to security planning.

Department of Homeland Security (DHS) components providing security for the Papal Visit include the following:

  • U.S. Secret Service, in conjunction with federal, state and local partners, will support events with intelligence and counterterrorism assets, explosive device mitigation, dignitary and VIP protection, interagency communications, critical infrastructure, and airspace security.
  • The Transportation Security Administration will provide operational support including personnel, equipment and communications infrastructure. This includes Visible Intermodal Prevention and Response (VIPR) Teams and Transportation Security Officers across the National Capital Region, New York City and Philadelphia.
  • The Federal Emergency Management Agency serves as the lead federal agency for emergency and consequence management and will coordinate consequence management activities throughout the events to ensure a quick and coordinated response to protect public health and safety.
  • U.S. Customs and Border Protection will provide operational support including venue security, non-intrusive inspection, and communications support.
  • U.S. Immigration and Customs Enforcement, Homeland Security Investigations will provide personnel to support venue security and augment dignitary protection.
  • The U.S. Coast Guard will provide maritime security 24-hours a day during the 2015 World Meeting of Families and enforce fixed security zones.
  • The DHS National Protection and Programs Directorate will maintain support 24-hours a day through the National Infrastructure Coordinating Center and National Cybersecurity and Communications Integration Center as well as provide support through Federal Protective Service personnel.
  • The DHS Office of Health Affairs will staff the National Biosurveillance Integration Center and through the BioWatch Program Office will provide personnel, equipment and supplies to support field operations.
  • The DHS Domestic Nuclear Detection Office will provide radiological and nuclear alarm adjudication support as well as detection capability support.
  • DHS will continue to monitor for threats surrounding the Pope’s visit as well as provide in-person support during events through the Office of Intelligence and Analysis.
  • The Office of Operations Coordination will maintain situation situational awareness through the National Operations Center, and coordinate federal information sharing and reporting activities with federal, state, local, tribal, and private sector partners across the homeland security enterprise.

The Pope will be addressing a joint session of Congress, so it will be interesting to see who attends the event. Remember Nancy Pelosi has been declared by the Vatican court no longer eligible for communion due to her stance on abortion. But, the Vatican has taken on a forgiveness posture for abortion under Pope Francis, while many Bishops and Cardinals are in revolt. While the White House stands with Planned Parenthood and selling unborn baby parts, will the Pope even address the matter during his U.S. tour?

The White House created their own guest list for the Pope without asking the Vatican and the Vatican is NOT pleased.

DailyCaller: President Barack Obama has attracted attention for planning to meet Pope Francis in the White House with a motley assortment of dissenting Catholics and others opposed to Catholic doctrine. Now, the Vatican is signaling that it isn’t happy.

Pope Francis is scheduled to meet Obama on the South Lawn of the White House next Wednesday, Sept. 23. Among those invited by Obama to meet Francis are Gene Robinson, the first gay Episcopal bishop in the U.S., Mateo Williamson, the transgender head of the LGBT Catholic group Dignity USA, and Sister Simone Campbell, a nun who lobbied for Obamacare’s passage despite the fact that it funds abortions and compels Catholic institutions to provide birth control for employees.

While the Vatican hasn’t publicly complained about the guest lineup, an anonymous Vatican official has told The Wall Street Journal they are not happy. According to the official, the Vatican fears Obama is attempting to lure Francis into a photo op where him being photographed next to these activists will be interpreted as an endorsement of their activities, and a repudiation of longstanding Catholic doctrine. This concern is heightened, the official said, because Obama doesn’t appear to have invited anybody to the White House from the U.S. anti-abortion movement, which has very close ties to the Catholic Church. If Obama really is planning to trap Francis with a photo op, it wouldn’t be the first time it’s happened to Francis. In July, Francis was caught off-guard on a visit to Bolivia when president Evo Morales presented him with a Communist-themed crucifix. Overall, though, the Obama administration has been trying to emphasize the ways it agrees with the Vatican, rather than the social issues like abortion where they diverge sharply. Vice President Joe Biden (who is Catholic) says he’s read all of Francis’s recent encyclical on climate change, and Francis’s visit to a Philadelphia prison could bolster Obama’s own push for criminal justice reform.

But friction may be inevitable, especially if the pope feels put off by Obama’s guest list in the White House. He plans to speak on the topic of religious liberty during his visit to Philadelphia, which may provide an opportunity to condemn Obamacare’s contraception mandate.

White House Press Secretary Josh Earnest has downplayed the importance of individual guests, telling reporters Thursday that there will be “15,000 other people” at the event.

 

It is expected for Pope Francis to address the migrant crisis not only in Europe but to pressure the United States to take in more, perhaps hundreds of thousands more.

Pope Francis has been very vocal in encouraging the Catholic community to help migrants fleeing the Middle East. It is expected he will take the opportunity to encourage the United States, during his speech in the joint session of the Congress. He is expected to encourage the U.S. to take greater steps in absorbing more migrants from around the world, giving them the benefits from America’s immigration program including food, shelter, medication, education and several other benefits.

“Vatican officials say Pope Francis will focus heavily on immigration during his visit. ‘The Pope obviously has a very soft spot in his heart for immigrants,’ said one Holy See insider. ‘He won’t say, ‘open all borders,’ but there’s no two ways about it, he will say, ‘let’s give our immigrant brothers and sisters a fair chance,'” reported Breitbart.

The United States however has already accepted more migrants than Argentina, the home of the Pope. The U.S. has the highest foreign-born population in all of the largest countries in the world, according to Breitbart.

The population of the U.S. takes up only 5 percent of the World Population. In this 5 percent, a total of 20 percent are migrants from different countries.

Obama Blocks Navy from Sailing Near Disputed Chinese islands

FreeBeacon: The Obama administration has restricted the U.S. Pacific Command from sending ships and aircraft within 12 miles of disputed Chinese-built islands in the South China Sea, bolstering Beijing’s illegal claims over the vital seaway, Pentagon leaders revealed to Congress on Thursday.

“The administration has continued to restrict our Navy ships from operating within 12 nautical miles of China’s reclaimed islands,” Senate Armed Services Committee Chairman Sen. John McCain (R., Ariz.) said in opening remarks criticizing the failure to guarantee safe passage for international commercial ships in Asia.

“This is a dangerous mistake that grants de facto recognition of China’s man-made sovereignty claims,” he said.

The South China Sea is a strategic waterway used to transport $5 trillion annually in goods, including $1.2 trillion in trade to the United States.

David Shear, assistant defense secretary for Asian and Pacific affairs, sought to play down the restrictions on Navy ship transits close to the islands. According to Shear, a regional freedom of navigation exercise took place in April and the tactic is “one tool in a larger tool box … and we’re in the process of putting together that tool box.”

Shear acknowledged that “we have not recently gone within 12 miles of a reclaimed area,” noting the last time a Navy ship sailed that close to a Chinese-built island was 2012.

The disclosure undermines statements made Wednesday by Defense Secretary Ash Carter who said the United States would not be coerced by China into not operating ships or aircraft in Asia. Carter said the United States “will continue to protect freedom of navigation and overflight.”

Shear insisted that in recent years the U.S. military has challenged “every category of Chinese claim in the South China Sea, as recently as this year.”

Blocking China from militarizing the new islands could include a range of options, including freedom of navigation operations, he said.

McCain, however, noted that the U.S. restrictions on close-in island military flights and ship visits were continuing despite the provocative dispatch of five Chinese warships in an unprecedented deployment to waters within 12 miles of Alaska’s Aleutian Islands—at the same time President Obama was concluding a recent visit to the state earlier this month.

A visibly angered McCain told Shear the best way to assert that international waters around the islands do not belong to China would be for American ships to make 12-mile passages by the disputed islands. “And we haven’t done that since 2012. I don’t find that acceptable, Mr. Secretary,” he said.

Adm. Harry Harris, commander of the U.S. Pacific Command, was asked if he is authorized to order ships to travel within 12 miles of any of the man-made islands and answered, no. Harris also said no U.S. surveillance aircraft have flown directly over any of the islands.

Asked why not, Harris stated: “I’ll just [say] that Pacom presents options, military options to the secretary. And those options come with a full range of opportunities in the South China Sea, and we’re ready to execute those options when directed.”

The restrictions appear to be an element of the Obama administration’s conciliatory policies toward China that have increased in the months leading up to the planned visit to Washington next week by Chinese President Xi Jinping.

The administration also has not taken steps to penalize China for large-scale hacking of U.S. government and private sector databases, although sanctions are planned.

China has been building islands on several reefs within the South China Sea for the past several years near the Paracels, in the northwestern sea, and near the Spratlys, near the Philippines. Several nations, including Vietnam, Philippines, and Malaysia have challenged Chinese claims to maritime sovereignty.

After ignoring the island building for several years, the Obama administration earlier this year began pressing the Chinese to halt the construction. The U.S. appeals were ignored.

A Chinese admiral recently declared that the entire South China Sea is China’s maritime territory.

“The South China Sea is no more China’s than the Gulf of Mexico is Mexico’s,” said Harris, who described himself as critic of China’s maritime behavior and large-scale military buildup.

Harris made clear implicitly during the hearing he did not agree with the restrictions on transit near the disputed islands but has been overruled by the president and secretary of defense.

“I think that we must exercise our freedom of navigation throughout the region …,” Harris said.

Pressed for his views on whether close passage of U.S. ships in the sea should be permitted, Harris said: “I believe that we should [be] allow[ed] to exercise freedom of navigation and flight—maritime and flight in the South China Sea against those islands that are not islands.”

Asked if he has requested permission for close-in island transits, Harris would not say, stating only that he has provided policy options for doing so to civilian leaders.

Harris said Pacific command surface ship commanders and crews, as well as Air Force pilots and crews, have orders when operating near China to “insist on our right to operate in international airspace and maritime space” and to respond professionally when challenged by Chinese warships or interceptor jets.

The four-star admiral warned that more incidents, such as the dangerous aerial intercept of a P-8 surveillance jet by a Chinese jet in 2014, are possible after China finishes building runways on Fiery Cross Reef and two other reefs.

With missiles, jet fighters, and warships stationed on the islands, “it creates a mechanism by which China would have de facto control over the South China Sea in any scenario short of war,” he said.

In a conflict the sites could be easily targeted, but “short of that, militarization of these features pose a threat, and certainly it poses a threat against all other countries in the region,” he said.

Shear also said the island militarization is a concern.

“The Chinese have not yet placed advanced weaponry on those features and we are going to do everything we can to ensure that they don’t,” Shear said. “This is going to be a long-term effort. There are no silver bullets in this effort. But we’re certainly complicating Chinese calculations already.”

Shear said U.S. forces are continuing to operate freely in the region and have deterred Chinese coercion of regional states.

“That we freely operate in the South China Sea is a success? It’s a pretty low bar, Mr. Secretary,” McCain said.

China’s dispatch of five warships to waters near the Bering Strait followed recent joint exercises with the Russians, after which the Chinese ships sailed near Alaska to demonstrated the ships’ ability to operate in the far north, Harris said, noting that he viewed the timing to the president’s Alaska visit as “coincidental.”

Sen. Dan Sullivan, (R., Alaska) said the Chinese action was a “provocation” and criticized the administration’s weak response. The Pentagon dismissed the Chinese ship transit as legal under international law.

“I thought it was more of a provocation and a demonstration of their interest in the Arctic,” Sullivan said. “I’m not sure that this White House would recognize a provocation if it was slapped in the face, and we need to be aware of that.”

Harris also said he is concerned by China deploying submarines, including nuclear missile submarines, further from its shores.

“We’re seeing Chinese submarine deployments extend further and further, almost with every deployment,” he said. “It has become routine for Chinese submarines to travel to the Horn of Africa region and North Arabian Sea in conjunction with their counter piracy task force operations. We’re seeing their ballistic missiles submarines travel in the Pacific at further ranges and of course all of those are of concern.”

China’s claims to have halted island construction and militarization on some 3,000 acres are false, McCain said.

“Recently released satellite images show clearly this is not true,” the senator said. “What’s more, China is rapidly militarizing this reclaimed land, building garrisons, harbors, intelligence, and surveillance infrastructure, and at least three air strips that could support military aircraft.”

Surface-to-air missiles and radars also could be added enabling China “to declare and enforce an air defense identification zone in the South China Sea, and to hold that vital region at risk,” McCain added.

Shear said the island building is nearly completed.

Meanwhile in the House, Rep. J. Randy Forbes (R., Va.), chairman of the House Armed Services subcommittee on seapower, led a group of 29 members of Congress in writing to President Obama and Carter, the defense secretary, urging the lifting of the restrictions on naval and air operations near the disputed islands.

“The longer the United States goes without challenging China’s unfounded claims to sovereignty over these artificial formations—and to territorial waters and exclusive economic rights in the surrounding water—the greater the consequences will be for regional security,” the lawmakers stated in the Sept. 17 letter.

“It is our belief that the Defense Department should act immediately to reaffirm the United States’ commitment to freedom of navigation and the rule of law.”

(Washington, DC) – Judicial Watch today released Obama administration correspondence containing a letter from Under Secretary of State for Management Patrick F. Kennedy asking Hillary Clinton’s lawyer to destroy all electronic copies of a classified email found in records Clinton decided to turn over to the State Department six months before.  Clinton’s attorney, David Kendall, rejected the request as Congress and other investigators had demanded electronic records be preserved.  The correspondence also shows Hillary Clinton has ignored a demand to turn over all electronic copies of the approximately 55,000 pages of emails she previously returned in paper form.  The correspondence was disclosed by the State and Justice Departments in a Judicial Watch Freedom of Information Act (FOIA) lawsuit in which Judicial Watch is asking a court to issue a preservation order to protect any emails Clinton has yet to turn over, including those emails in which she and her lawyers unilaterally determined to be personal. The May 22, 2015, letter from Kennedy to Clinton attorney Kendall reads in part:

I am writing in reference to the following e-mail that is among the approximately 55,000 pages that were identified as potential federal records and produced on behalf of former Secretary Clinton to the Depa1tment of State on December 5, 2014: E-mail forwarded by Jacob Sullivan to Secretary Clinton on November 18, 2012 at 8:44 pm (Subject: Fw: FYI- Report of arrests -possible Benghazi connection).

Please be advised that today the above referenced e-mail, which previously was unclassified, has been classified as “Secret” pursuant to Section 1.7(d) of Executive Order 13526 in connection with a review and release under the Freedom of Information Act (FOIA). In order to safeguard and protect the classified information, I ask – consistent with my letter to you dated March 23 2015 – that you, Secretary Clinton and others assisting her in responding to congressional and related inquiries coordinate in taking the steps set forth below. A copy of the document as redacted under the FOIA is attached to assist you in your search.

Once you have made the electronic copy of the documents for the Department, please locate any electronic copies of the above-referenced classified document in your possession. If you locate any electronic copies, please delete them. Additionally, once you have done that, please empty your “Deleted Items” folder.

The Kennedy letter shows that the State Department knew that Clinton had classified material on her email system two months before it was disclosed publicly on July 23, when Congress was alerted to the issue by the inspector general of the intelligence community.

Clinton’s attorney responds several weeks later, on June 15 – saying it would not be “prudent” to delete the email.  David Kendall writes:

This will also confirm that, pursuant to your request, we have deleted all electronic copies of this document, with the following exception. I have received document preservation requests pertaining to the 55,000 pages of e-mails from the House of Representatives Select Committee on Benghazi, the Inspector General of the State Department, and the Inspector General of the Intelligence Community (DNI). I have responded to each preservation request by confirming to the requestor that I would take reasonable steps to preserve these 55,000 pages of former Secretary Clinton’s e-mails in their present electronic form. I therefore do not believe it would be prudent to delete, as you request, the above-referenced e-mail from the master copies or the PST file that we are preserving.

Clinton’s attorney suggests the information may yet be deleted.  Kendall’s June letter states:

Once the document preservation requests referenced above expire, we will proceed to make the requested deletions. This present arrangement would cover the single document recently classified “Secret”. Should there be further reclassifications during the Department’s FOIA [Freedom of Information Act] review of former Secretary Clinton’s e-mails, it also would cover any such additional documents.

The State Department also disclosed a July 2, 2015, letter from the chief records officer at National Archives and Records Administration (NARA), Paul M. Wester Jr., to Margaret P. Grafeld, deputy assistant secretary for global information services at the State Department, that shows Clinton never turned over the records as requested.  Webster again requests State Department action on the Clinton records:

I would like to reiterate our request that the Department contact the representatives of former Secretary Clinton to secure the native electronic versions with associated metadata of the approximately 55,000 hard copy pages of emails …

Despite this request, the State Department seems never to have followed up with Clinton for the data.  On August 6, the State Department reported to the court in another Judicial Watch lawsuit that it had demanded that Mills and Abedin “return all copies of potential federal records in your possession.”  The State Department did not provide any correspondence demanding Mrs. Clinton return all copies of potential federal records.

A letter by Kennedy on September 14, 2015, to FBI Director James B. Comey, shows that the State Department only recently again tried to obtain electronic copies of the Clinton records:

On May 22, 2015, the Department requested from former Secretary Clinton’s attorney, David Kendall, that he provide an electronic copy of the approximately 55.000 pages identified as potential federal records and produced on behalf of former Secretary Clinton to the Department of State on December 5, 2014. … On June 15, 2015, Mr. Kendall replied that, pursuant to my request, he would “copy onto a disc the electronic version of the emails previously produced in hard copy to the Department on December 5, 2014.” … Before Mr. Kendall could provide that disc to the Department, however, we understand that the FBI obtained the relevant electronic media. Accordingly, we request from the FBI an electronic copy of the approximately 55.000 pages identified as potential federal records and produced on behalf of former Secretary Clinton to the Department of State on December 5, 2014. This request is in accordance with counsel we have received from the National Archives and Records Administration (NARA).

Additionally, to the extent the FBI recovers any potential federal records that may have existed on the server at various points in time in the past, we request that you apprise the Depa11ment insofar as such records correspond with Secretary Clinton’s tenure at the Department of State. Because of the Department’s commitment to preserving its federal records, we also ask that any recoverable media and content be preserved by the FBI so that we can determine how best to proceed.

As with the email gaps uncovered by Judicial Watch this week, this latest find raises questions about whether Clinton told the truth last month when she declared, under penalty of perjury, “I have directed that all of my emails on clintonemail.com in my custody that were or potentially were federal records be provided to the Department of State….”  Clinton made this statement in response to a court order Judicial Watch obtained in other FOIA litigation.

“Judicial Watch exposed a cover-up with criminal implications. Why on Earth would John Kerry’s State Department tell Mrs. Clinton to delete classified Benghazi records before finding out where and how this material had been disclosed?” said Judicial Watch President Tom Fitton.  “That the State Department asked Clinton’s lawyer to destroy federal records shows a level of distain for the rule of law that goes beyond the pale.  These letters should have been disclosed to more than one federal judge.  The evident contempt and obstruction of justice by both Mrs. Clinton and the Obama administration will be brought to the attention the courts.”
