2014 Funding Exactly What in the Federal Government

There is likely much more included in the $1.1 trillion spending bill however, below will demonstrate some of the items, as some of it is just stupid. Reading below is a good exercise for all Americans that want to understand the financial machinery of government spending with your money.

The items included are likely to change while the bill is in committee so the numbers and earmarks are dynamic in nature.

The $1.01 trillion spending bill unveiled late Tuesday will keep most of the federal government funded through next September — and it’s packed with hundreds of policy instructions, known on Capitol Hill as “riders,” that will upset or excite Democrats, Republicans and various special interest groups.

So, what’s in the bill? We’ve sifted through the legislation, consulted supporting documents from Democratic and Republican aides, and called out some of the more notable and controversial elements below. (If you want to review detailed reports on all 12 parts of the spending bill, click here.)

ABORTION:

The bill once again bans using federal funding to perform most abortions; blocks the use of local and federal funding for abortions in the District of Columbia; and blocks the use of federal dollars for abortions for federal prisoners. Republicans say that there’s also new language directing the secretary of health and human services to ensure that consumers shopping for health-care coverage on the federal exchange can tell whether a plan covers abortion services.

AFFORDABLE CARE ACT:

The law is still funded, but there’s no new money for it. There’s also no new ACA-related funding for the Internal Revenue Service and the Centers for Medicare and Medicaid Services, the two agencies most responsible for implementing the law. The bill also would cut the budget of the Independent Payment Advisory Board — what Republicans have called “the death panel” — by $10 million.

AFGHANISTAN:

Congress withholds funding for the Afghan government “until certain conditions are met,” including implementing the bilateral security agreement reached with the United States.

AMTRAK:

The nation’s rail passenger service earns $1.39 billion, the same amount it currently receives. The rail service carries passengers through 46 states and hit an all-time high of 31.6 million passengers during the last fiscal year, according to Democratic aides.

CAMPAIGN FINANCE:

The bill would dramatically expand the amount of money that wealthy political donors could inject into the national parties, drastically undercutting the 2002 landmark McCain-Feingold campaign finance overhaul. Bottom line: A donor who gave the maximum $32,400 this year to the Democratic National Committee or Republican National Committee would be able to donate another $291,600 on top of that to the party’s additional arms — a total of $324,000, ten times the current limit. CENTERS FOR DISEASE CONTROL:

The agency would get more than $6.9 billion, an increase of about $42.7 million. The nation’s leading disease-fighters also get $30 million to help fight Ebola (see below).

CLEAN WATER ACT:

In a win for Republicans, the spending bill blocks the Environmental Protection Agency from applying the law to certain farm ponds and irrigation ditches — a move that GOP aides said would benefit farmers.

DODD-FRANK:

Democrats agreed to make some of the biggest changes yet to the 2010 financial regulatory reforms. In a deal sought by Republicans, the bill would reverse Dodd-Frank requirements that banks “push out” some of derivatives trading into separate entities not backed by the Federal Deposit Insurance Corporations. Ever since being enacted, banks have been pushing to reverse the change. Now, the rules would go back to the way they used to be. But in exchange, Democrats say they secured more money for the enforcement budgets at the Commodity Futures Trading Commission and the Securities and Exchange Commission.

EBOLA:

Roughly $5.4 billion is provided across several agencies to combat the spread of the disease in the United States and around the world. The amount is less than the $6 billion Obama requested.

EGYPT:

The beleaguered country gets $1.3 billion in military aid and $150 million in economic aid — but the money is subject to “democracy and human rights conditions,” while the secretary of state can make exceptions for counterterrorism and border security operations.

EMBASSIES:

There’s $5.4 billion for security at U.S. embassies worldwide, $46 million more than Obama requested. The total includes new money to implement recommendations from the Benghazi Accountability Review Board. The bill also once again bans any embassy construction money to be spent on the lavish new U.S. embassy in London.

ENVIRONMENTAL PROTECTION AGENCY:

The agency gets $8.1 billion, down $60 million from the last fiscal year. The agency’s budget has been slashed by $2.2 billion, or 21 percent, since fiscal 2010, according to GOP aides. The cuts mean that EPA will have to reduce its staffing to the lowest levels since 1989.

ERIC CANTOR:

Well, kind of. The former House majority leader stunned the political world by losing in a GOP primary last summer. But Congress agreed to provide $12.6 million for his signature legislative achievement — the Gabriella Miller Kids First Act, which authorizes new federally-funded pediatric research. The bill was paid for by slashing federal funding for political conventions.

FEDERAL WORKER PAY (AND CONFERENCES):

The bill allows a 1 percent pay raise ordered by Obama to take effect in January. And the legacy of embarrassing spending scandals at federal agencies persist as Congress once again banned or put limits on certain conferences, official travel and some employee awards.

FOOD SAFETY (AND THE FDA)

There’s $2.589 billion for the Food and Drug Administration, a $37 million increase from last year. There’s $27 million in new funding for the Food Safety Modernization Act. The Food Safety and Inspection Service would receive $1.016 billion, a $5 million increase.

GUANTANAMO BAY:

Once again the Obama administration is banned from transferring terrorism detainees to the United States from the U.S. military facility in Cuba. There’s also a ban on building or buying any facility in the U.S. to house detainees. But the bill allows for the ongoing transfer of detainees to other countries.

HEROIN:

In a modest attempt to address a growing crisis with the illicit drug, lawmakers are adding $7 million for a new anti-heroin task force run out of the Justice Department’s COPS Office. The money will be used as part of a competitive grant program for drug enforcement, including investigations and operations to stop the distribution or sale of the drug, according to Democrats.

IMMIGRATION:

The bill only funds the Department of Homeland Security, which oversees most immigration policy, until February. But negotiators gave new money for immigration programs at other federal agencies. There’s $948 million for the Department of Health and Human Service’s unaccompanied children program — an $80 million increase. The program provides health and education services to the young migrants. The department also gets $14 million to help school districts absorbing new immigrant students. And the State Department would get $260 million to assist Central American countries from where of the immigrant children are coming.

INTERNAL REVENUE SERVICE:

One of the GOP’s favorite targets will see its budget slashed by $345.6 million. The nation’s tax agency also would be banned from targeting organizations seeking tax-exempt status based on their ideological beliefs.

ISRAEL:

There’s $3.1 billion in total aid for the country plus $619.8 million in defense aid.

JOE BIDEN:

The legislation once again enacts a pay freeze for the vice president “and senior political appointees.”

LIBYA:

The troubled country cannot receive any U.S. aid until the secretary of state confirms the country is cooperating with ongoing investigations into the September 2012 attack at the U.S. consulate in Benghazi, Libya.

JORDAN:

The Arab kingdom would receive $1 billion in economic and military aid, in addition to U.S. humanitarian aid for millions of Syrian refugees.

LIGHT BULBS:

The bill once again prohibits new standards that would ban the use of cheaper, less energy efficient incandescent bulbs. The proposal was first introduced and set in motion by the Bush administration, but the Obama White House allowed the change to continue, despite sustained consumer demand for older bulbs.

MARIJUANA:

The District of Columbia will be prohibited from legalizing marijuana for the much of the coming year. The development — upending a voter-approved initiative — shocked elected D.C. leaders, advocates for marijuana legalization and civil liberties groups. The bill also would block the Justice Department from interfering with state-level medical marijuana measures and prohibits the Drug Enforcement Agency from interfering with industrial hemp production.

METRORAIL:

The D.C. region’s subway and bus system would earn $150 million in federal dollars for continued improvements. That’s part of $10.9 billion set to be doled out for transit programs nationwide, including the construction of new rail and rapid bus projects in California, Colorado, Florida, Maryland, North Carolina and Texas. But Republicans stress that the bill has no new federal funding for high-speed rail projects, especially the ambitious Los Angeles-to-San Francisco routes envisioned by California Democrats.

MILITARY PAY AND PERKS:

Military service members will receive a 1 percent pay increase next year. But there’s a pay freeze for generals and flag officers. The bill also ends a five percent discount on tobacco and tobacco-related products sold at military exchanges.

NATIONAL MUSEUM OF AFRICAN AMERICAN HISTORY:

The agreement includes $24 million to complete the federal government’s contribution to the new museum being built on the Mall. The rest of the money will be raised through private donations.

NATIONAL INSTITUTES OF HEALTH:

The nation’s premier medical research agency would receive $30.3 billion, a $150 million overall increase. Democrats noted that the new funding helps especially for ongoing Alzheimer’s and brain research programs.

OFFICIAL PORTRAITS:

You’re a government official and want an official portrait? You’ll have to pay for it (or raise the funds). The bill bans taxpayer funding for official portraits of any Executive Branch employees, lawmakers and heads of legislative agencies.

OVERSEAS MILITARY OPERATIONS:

There’s $1.3 billion for a new Counterterrorism Partnership Fund; $5 billion for military operations to combat the Islamic State, including $1.6 billion to train Iraqi and Kurdish forces; $500 million for a Pentagon-led program to train and equip vetted Syrian opposition fighters; $810 million for ongoing military operations in Europe, including requirements that at least $175 million is spent in support of Ukraine and Baltic nations.

PALESTINIAN AUTHORITY:

The bill stops assistance to the Palestinian Authority if it becomes a member of the United Nations or UN agencies without an agreement  with Israel. It also prohibits funds for Hamas.

PENSIONS:

For the first time, the benefits of current retirees could be severely cut, part of an effort to save some of the nation’s most distressed pension plans. The change would alter 40 years of federal law and could affect millions of workers, many of them part of a shrinking corps of middle-income employees in businesses such as trucking, construction and supermarkets. U.S. POSTAL SERVICE:

You like your mail on Saturdays? You’ll keep your mail on Saturdays. The bill requires the mail service to continue six-day deliveries, despite a years-long attempt to cut back on service to save money.

TRUCKING:

In a victory for the trucking industry, the bill blocks new Transportation Department regulations requiring truckers to get two nights of sleep before starting a new work week. The regulation slashed a typical trucker’s work week to 70 hours, down from 82 hours.

UNITED NATIONS:

The perennial ban on providing money for the ongoing renovation of U.N. Headquarters in New York remains intact.

U.S. CAPITOL (AND RELATED AGENCIES):

There’s $21 million to continue restoring the cast-iron Capitol Dome. And $348 million for the U.S. Capitol Police (a force with 1,775 officers). Lawmakers also plan to save $10,000 by allowing the congressional Office of Compliance to email congressional staffers about their employment rights. Old rules required the office to send such notices by snail mail. Finally, for the first time the agency formerly known as the Government Printing Office is now officially known as the Government Publishing Office.

VETERANS:

After a year of embarrassing scandals at the sprawling Department of Veterans Affairs, lawmakers are making good on promises to provide more money and oversight. There’s a total of $159.1 billion in discretionary and mandatory spending. Of that, $209 million was added to address new costs related to the bipartisan veterans’ reform bill passed last summer. The legislation calls for adding medical staff and expanding dozens of facilities. In order to specifically addressing the “wait list” scandal, the VA’s inspector general is getting a $5 million budget increase to continue investigating lapses in patient care.

WHISTLEBLOWERS:

The bill includes language ensuring that government contractors are not barred from reporting allegations of waste, fraud or abuse if they sign a confidentiality agreement. And the Occupational Safety and Health Administration would receive a $500,000 increase for its enforcement of existing whistleblower laws.

WHITE HOUSE BUDGET:

There’s $222 million for executive mansion operations, a $10 million increase. The money pays for the National Security and Homeland Security councils, the Council of Economic Advisers, the vice president’s office and the executive residence. The bill doesn’t provide any new funding “to address security weaknesses at the White House complex,” according to Democrats. But the U.S. Secret Service would be allowed to use some of its funding “to prepare and train for the next presidential election campaign,” Democrats said.

WOLVES:

Well, only if you’re attacked. There’s $1 million in the bill “to compensate ranchers for livestock killed by wolves.”

YUCCA MOUNTAIN:

There’s no new money for the site, but current money for it must be spent pursuant to a recent court decision. Republicans say that the bill continues to leave open the possibility that the site could be used someday to store nuclear waste — but that won’t happen as long as Senate Majority Leader Harry M. Reid (D-Nev.) is around.

Tug of War Over Qaddafi’s Wealth

Did it really take all this time to discover the location of the wealth of Libya, hidden by Qaddafi? Well no, it has taken this long to understand who is part of the wrangling for control.

Muammar Gaddafi was able to build his massive personal wealth thanks to a violent and domineering control over Libya’s natural resources. Specifically their rich supply of oil. Libya has the largest supply of oil in Africa and the tenth largest in the world. Gaddafi used Libya’s oil to print money for 40 years! During that time he spread his money around the globe through family members, Swiss bank accounts, real estate and investments. Estimated at $200 billion, he had enough to give $30,000 to each of Libya’s 6.6 million citizens.

At the beginning of the Lybian conflict, authorities discovered and seized roughly $67 billion of Gaddafi’s wealth hidden in bank accounts around the globe. England, France, Italy and Germany seized another $30 billion and the Obama administration found a staggering $37 billion in the United States. Investigators suspect that Gaddafi hid an additional $30 billion around the world.

As more investigations take place, it looks like Gaddafi had money stashed or invested in almost every major country in the world including the United States, Europe, the Middle East and Asia. In addition to bank accounts, Muammar owned a stake in the Italian soccer club Juventus and the car company Fiat. He also was a minority of London’s Financial Times. Investigators from U. N. Security are still waiting on many countries to resolve what Gaddafi might have within their borders. Several neighboring African nations refused to freeze Gaddafi’s accounts because of their fear and loyalty to the ruthless leader. Now that he’s dead, we should see even more money come to light. So, where is the wealth of the failed and rogue leader and country? Ah, SA. But it will likely be embargoed for a long while after all the forensic accounting and criminal activity is matched to a comprehensive investigation. Oh yes, one more thing, our own U.S. Treasury and Secretary of State John Kerry is actively engaged in the process. It is a sure bet many other global leaders and the United Nations will complicate resolutions as their names are also likely attached.

Johannesburg – The South African government and President Jacob Zuma have been caught in the middle of an international wrangle over as much as R2 trillion in US dollars as well as hundreds of tons of gold and at least six million carats of diamonds in assets belonging to the people of Libya.

What could be the world’s largest cash pile is stored in palettes at seven heavily guarded warehouses and bunkers in secret locations between Joburg and Pretoria.

The Libyan billions have led to a Hawks investigation into possible violation of exchange controls as well as international interests from the UN and the US.

It has also led to heightened interest in the local and international intelligence community as well as the criminal underworld.

Those interested in the Libyan loot include several high-ranking ANC politicians, several business leaders, a former high court judge and a number of private companies.

The R2-trillion held in warehouses is separate from several other billions, believed to be in excess of R260 billion, held legally in four banks in South Africa.

Other legal assets include hotels in Joburg and Cape Town.

The Sunday Independent has seen official South African government documents which confirm that at least $179bn in US dollars is kept, illegally, in storage facilities across Gauteng.

Soon after Muammar Gaddafi’s death in October 2011, the new Libyan government embarked on a large-scale mission to recover legal assets in South Africa, the rest of Africa, the US and Europe.

In South Africa, the focus of the Libyans has been on assets brought into the country legally as well as illegally.

Last year, the Libyan government put in place a separate process to identify and repatriate the illegal assets in South Africa.

Investigations by The Sunday Independent on the illegal assets have led to allegations that:

* The US dollar loot was ferried to South Africa in at least 62 flights between Tripoli and South Africa. The crew of the planes were mainly ex-special forces from the apartheid era. The crew are understood to have deposed affidavits clarifying their role in an effort to avoid criminal charges.

* The money, gold and diamonds were moved to South Africa. Most of it was kept here and some was moved to neighbouring southern African countries. Most of the assets were taken out of Libya after Zuma got involved in an AU process to persuade then Libyan President Gaddafi to step down after an Arab-spring-like uprising to force him out of office.

Gaddafi was killed as he tried to flee Tripoli.

The Libyan government has formed a special board, the National Board for the Following Up and Recovery of Libyan Looted and Disguised Funds, to recover the assets. Now two companies have presented themselves to the South African government, claiming they were mandated by the national board to recover the funds.

The two companies are the Texas-based Washington African Consulting Group (WACG), led by its chief executive Erik Goalied, and Maltese-based Sam Serj, led by its chief executive, Tahah Buishi. Both companies claim to be the only legitimate representatives of the Libyan government.

Goalied has dismissed Sam Serj as impostors who want to stage the “biggest heist in the world”.

He said they were using fake documents and had used a number of South Africans, with the lure of lucrative commissions, to get the South African government to comply. Goalied has formalised his allegations about Sam Serj in an affidavit that he has submitted to the National Prosecuting Authority, who have passed it on to the Hawks.

He told The Sunday Independent that on September 26 he met with the Libyan Prime Minister Abdullah al-Thani in New York, where both parties reconfirmed that the WACG should work with the South African government. “The assets are important but the bigger goal is to resolve this smoothly so that relations between South Africa and Libya can improve,” he said.

Goalied said the Libyans did not necessarily want the loot to be sent back to Tripoli. They wanted full and legal control of the assets which, he added, could be used for investments and other job-creation projects that would benefit both countries.

Last month, Goalied wrote to Zuma asking for co-operation and assistance in resolving the assets saga. The Presidency wrote to him this week, acknowledging his letter.

The Presidency has referred The Sunday Independent’s queries to the Treasury. The Treasury, in turn, referred The Sunday Independent to a statement issued last June in which the government called on those with knowledge of Libyan assets in South Africa to come forward. Hawks spokesman Paul Ramaloko declined to confirm the probe.

The Sunday Independent has also established that Goalied has also written to UN Secretary-General Ban Ki-moon and US Foreign Secretary John Kerry asking for assistance. The UN adopted Resolution 438 which forces countries that have Libyan assets to return them.

The second company – Sam Serj – has already been in South Africa to discuss the return of the assets.

Sam Serj chief executive Buishi claimed his company was the only legitimate entity with a mandate to find and recover assets that belong to the people of Libya.

Buishi said his company has been contracted by the Libyan government to trace and recover assets looted by Gaddafi and those close to him.

He said the assets had been traced to South Africa, Libya’s neighbour, Tunisia, and several countries in Europe.

“We have been contracted by the Libyan government and are working with the South African government to recover the looted assets.

“We had a good meeting during our last visit with the then-minister of finance, Pravin Gordhan.

“We are working with the South African government. Hopefully, there will be a delegation to South Africa to repatriate the assets or come to some sort of arrangement.

“We want to work with the South African government to not only recover the assets but to find ways of re-investing them in South Africa.

“We want the assets to be identified as belonging to the Libyan people.

“Politically, we are trying to help the new Libya integrate with the rest of the African continent. Libya is a very big and rich country and together with South Africa can play a strategic role in Africa,” Buishi said.

Several sources told The Sunday Independent that the Libyans have complained to the UN and have placed South Africa and Zuma on terms, threatening to lay charges of theft with the International Criminal Court if the assets were not returned promptly.

The Sunday Independent understands that the money was brought in by a company, which has hired former SADF special forces and is keeping the warehouses where the money, gold and diamonds are being kept under 24-hour surveillance.

Other cash assets, running into hundreds of millions of rand, are being kept in accounts in South Africa’s major banks.

Several sources have confirmed that the ex-apartheid era special forces pilots and soldiers have deposed affidavits that are designed to protect them from, among others, money-laundering charges.

WASHINGTON—U.S. Senator Jeff Sessions (R-AL), Ranking Member of the Senate Budget Committee and a senior member of the Senate Judiciary Committee, released the following comment today on a bulletin issued by U.S. Citizenship and Immigration Services (USCIS) announcing a new facility in Crystal City, Virginia, with plans to hire 1,000 staff, in order to begin immediate implementation of the President’s wage-reducing amnesty and work authorization decree:

“It has just been discovered today that the Obama Administration is now opening a new USCIS facility in Crystal City, Virginia, for the purpose of immediately implementing the President’s imperial immigration decree. They are in the process of hiring 1,000 full-time staff to quickly approve applications for the President’s illegal amnesty, which will provide work permits, photo IDs, Social Security, and Medicare to illegal immigrants—all benefits rejected by Congress. This action will mean that American workers, their sons, their daughters, their parents, will now have to compete directly for jobs, wages, and benefits with millions of illegal immigrants.

This facility is a clear symbol of the President’s defiance of the American people, their laws, and their Constitution. He is hiring federal employees to carry out a directive that violates the laws Congress has passed in order to foist on the nation laws Congress has repeatedly refused to pass.

Some have suggested that implementing this amnesty would not have a financial cost, but this action unmistakably demonstrates otherwise. Moreover, the USCIS employees themselves have made plain that taxpayers will be on the hook, warning through their union that the agency is an ‘approval machine’ that will ‘rubber stamp’ applications for amnesty.

Year after year, our annual spending bills include numerous restrictions on how federal money can and cannot be spent. Congress funds programs that are worthy and does not fund programs it deems unworthy. The President cannot spend money unless the Congress approves it, and certainly the Congress should not approve funds for an illegal amnesty.

The American people need a voice. Why were we elected, if not to serve the citizens who sent us here?”

The bulletin lists 32 examples of job openings, each of which was posted online on November 21.

They include a chief of staff who will earn between $124,995 and $157,100 per year, and program analysts who will earn more than $138,000. Jobs earmarked for recent college graduates start in the range of $34,415 to $55,421.

The White House did not respond to a question about how far in advance the decision was made to open the hiring floodgates.

USCIS similarly did not respond to a request for comment about how long its plan had been in the works.

Alabama Republican Sen. Jeff Sessions blasted the administration on Wednesday for the move.

Meanwhile Texas Attorney General Greg Abbott filed a federal lawsuit that involves the following states: Alabama, Georgia, Idaho, Indiana, Kansas, Louisiana, Maine, Mississippi, Montana, Nebraska, North Carolina, South Carolina, South Dakota, Texas, Utah, West Virginia and Wisconsin. More details here.

Where is the FBI?

Former President Bill Clinton pushed back against the charge that President Obama and his fellow Democrats are card-carrying members of the Communist Party — telling supporters Monday that “nobody’s seen a communist in over a decade” and chastizing a freshman Republican for name-calling.

Invoking the specter of Communist-hunter Sen. Joseph McCarthy, Clinton blasted Rep. Allen West (R-Fla.), who in April said that he could identify 80 members of the U.S. House who were Communists — pointing to a caucus of House liberals when pressed for evidence.

Where is the FBI?

Former President Bill Clinton, his wife Hillary and hundreds in the Obama administration who full well there are communists in the federal government, at universities across the country and across all spectrums of media. Need more proof?

Scan the signage in the photos taken at Ferguson street protests across the nation and note that a handful of groups’ names reoccur.  Among them are REVCOM.US (Revolutionary Community Party USA , A.N.S.W.E.R. Coalition (founded by the pro-Leninist Becker brothers and aligned with the Party for Socialism and Liberation), Peoples Power Assemblies, Socialist Worker.org, and the International Action Center (founded by Jimmy Carter’s former Attorney General, Ramsey Clark, in 1992). There are more.

Standing behind the signs are well-funded 501(c)(3) groups that receive millions of dollars every year through donations and foundation grants, and then allocate monies to promote social change.

It’s a one-two-three punch involving community organizers, supported by moneyed enablers, who marshal protesters to the street carrying signs with organizational ties most know nothing about.     

All of it is well-organized, well-executed, and well-funded by intelligent, well-rehearsed, highly-motivated, ideologically-driven zealots for fundamental transformation in America, and, for some, the world. It’s all perfectly legal.

Where is the FBI?

Where does the money come from that is financially supporting these groups and protests? Organizations that, in recent years, have received direct funding and assistance from George Soros and his Open Society Institute (OSI), For a complete list go here.

But there is more and you need to pay attention as the leadership of these groups get unfettered access to the White House and to media.

Where is the FBI? Who performed the background checks of these people and approved access?

Where is the FBI?

Then in 1954 a law was passed title the Communist Control Act. The spirit of the law is to identify organizations and people attempting to overthrow the system of government including the Federal and State level. Sure in garden variety terms this has not happened, but when it comes to political correctness, edicts, mandates, enforcing law and prosecution, Communism is here and it is effective, as noted by meetings today in the White House and in towns such as Ferguson, Oakland, St. Louis and Chicago.

Where is the FBI? Where are you parents? Where is the top leadership at the Department of Education? Where is the leadership of universities and the donors?

 

 

UPDATE: No Access to 2,500 Documents IRS to WH

Update:  12/3/14 It seems that Treasury Secretary Jack Lew has intervened with the court’s decision forcing release of these documents. The White House is also working over-time to ensure the Judge’s ruling is impeded. This is more law-FARE.

Court Rules that TIGTA Must Process FOIA Request Regarding Investigations Into

Tax Records Improperly Shared with the President

WASHINGTON –The U.S. District Court for the District of Columbia ruled Monday that the Treasury Inspector General for Tax Administration (TIGTA) must process an October 9, 2012 Cause of Action Freedom of Information Act (FOIA) request seeking documents about investigations into unauthorized disclosures of taxpayer information to the Executive Office of the President.

Cause of Action’s Executive Director Dan Epstein said:

The court has ruled that the federal government cannot hide behind confidentiality laws to prevent Americans from knowing if our President has gained unauthorized access to their tax information. This is a decisive win for all Americans and for government transparency and accountability. The public already knows the President uses FOIA to shield his targeting of the press and this ruling prevents the President from using FOIA to shield his targeting of taxpayers.

Revealed: 2,500 new documents in IRS / W.H. harassment cases

In a shocking revelation, the Treasury Inspector General has identified some 2,500 documents that “potentially” show taxpayer information held by the Internal Revenue Service being shared with President Obama’s White House.

The discovery was revealed to the group Cause of Action, which has sued for access to any of the documents. It charges that the IRS and White House have harassed taxpayers.

In an email from the Justice Department’s tax office, an official revealed the high number of documents, suggesting that the White House was hip deep in probes of taxpayers, likely including conservatives and Tea Party groups associated with the IRS scandal.

In requesting a delay in the delivery date of the documents, Justice told Cause of Action, “The agency [Treasury Inspector General for Tax Administration] has located 2,500 potentially responsive documents and anticipates being able to finish processing 2,000 of these pages by the December 1 date. It needs the additional two weeks to deal with the last 500 pages to determine if they are responsive and make any necessary withholdings.”

Cause of Action, which calls itself “Advocates for Government Accountability,” wasn’t surprised by the number of documents. It had filed suit to win access to them and a federal judge shot down Treasury’s earlier bid to hide the documents.

“This disclosure, coming only after Cause of Action sued TIGTA over its refusal to acknowledge whether such investigations took place, and after the court ordered TIGTA to reveal whether or not documents existed, signals that the White House may have made significant efforts to obtain taxpayers’ personal information,” it said in a statement to Secrets.

The disclosure follows the agency’s recovery of 30,000 “lost” emails from former IRS executive Lois Lerner, the central figure in the IRS-Tea Party scandal.

Cause of Action said the latest finding renews their “concerns about the decaying professionalism of, and apparent slip into partisanship by, IRS’s senior leadership.”

My client wants to know if you would consent to a motion pushing back (in part) TIGTA’s response date by two weeks to December 15, 2014. The agency has located 2,500 potentially responsive documents and anticipates being able to finish processing 2,000 of these pages by the December 1 date. It needs the additional two weeks to deal with the last 500 pages to determine if they are responsive and make any necessary withholdings. We would therefore like to ask the court to permit the agency to issue a response (including production) on December 1 as to any documents it has completed processing by that date, and do the same as to the remaining documents by December 15. I note that the court’s remand was for a “determin[ation],” which the D.C. Circuit has recently explained can precede actual production by “days or a few weeks,” but we would prefer to simply agree on a date for turning over any of the remaining 500 documents that may be responsive.
