Critics blast Massachusetts city’s new ‘essay’ rule for gun-carry applicants

FNC: Critics are blasting a Massachusetts city’s new law that they claim requires residents applying for a license to carry handguns to write “an essay” and pay upwards of $1,100 for training.

The new laws take effect this week in Lowell, a city of 110,000 that lies 35 miles north of Boston. Pushed by Police Superintendent William Taylor and passed by the City Council, they require applicants for unrestricted handgun licenses to state in writing why they should receive such a license. Taylor, who was unavailable for comment on Monday, has sole discretion for approving or denying the applications.

“It is absurd that people should have to write an essay to the town to explain why they should be able to exercise their constitutional rights,” said Jim Wallace, executive director of Gun Owners Action League of Massachusetts. “We already have a very strict set of gun laws in the state, but this is way over the top.”

State law sets guidelines and requirements, but gives local chiefs of police broad discretion in implementation. While other cities and towns in Massachusetts have tough licensing regulations, Lowell’s new requirements, which also include taking a gun safety course over and above one already required by the state, prompted complaints at a public hearing last week.

“I will never write an essay to get my rights as an American citizen,” resident Dan Gannon told the City Council.

The new policy was prompted in part by a year-old federal lawsuit brought by Commonwealth Second Amendment, a Bay State gun-rights group. Attorney David Jensen said the suit stems from Lowell’s history of denying qualified applicants permits to carry handguns without what the plaintiffs consider a legitimate rationale.

Jensen said the jury is still out on whether the new policy will prove a remedy or just a more formal system for rejecting applications.

“The question right now is what they actually do,” Jensen said. “Our initial response to that would be that the Second Amendment secures the right to keep and bear arms. You really shouldn’t be required to write an essay explaining why you would like to exercise this fundamental right.”

Lowell Police spokesman Capt. Timothy Crowley said characterizing the written requirement as an “essay” is not accurate.

“If you want a license to carry a firearm unrestricted wherever you want and whenever you want, the superintendent is just looking for some documentation as to why,” Crowley said. “That is not unreasonable to most people.”

Despite the criticism, the new rules were adopted unanimously and are set to take effect this week.

“We’re no longer taking a cookie-cutter approach to issuing firearms licenses,” City Manager Kevin Murphy told the Lowell Sun, noting that the new policy will allow Taylor to look more closely at each applicant.

That’s exactly what concerns Wallace, who urged Lowell residents not to adhere to the new rules and to simply turn to the courts if and when their applications are denied.

“It’s like having a college professor say, ‘I’m going to read your essay and if I don’t like it, I’m going to give it back to you,’” Wallace said.

A 1998 state law known as the Gun Control Act included a raft of new regulations, fees and requirements that contributed to an 80 percent reduction in gun licenses over time, according to Wallace. The new law in Lowell, which Taylor said has about 6,000 gun owners with licenses to carry, will require a specialized training course.

A local firearms-safety instructor, Randy Breton, told the Sun the training requirement appeared designed to purposely make it cost-prohibitive to apply for a gun permit. He said one five-day course approved by the city costs $1,100.

“It’s beyond ridiculous,” Breton told the newspaper.

Having been so close to the mater of the Benghazi attack since it happened and deeply researching all the facts pre and post attack, seeing the movie was a personal quest to complete the circle of known circumstances and facts.

There were clearly political objectives by not only the U.S. State Department in cadence with other foreign diplomatic agencies with regard to Libya. This played out on the screen at the beginning of the movie. It is the common conclusion by the majority with interest in the matter of Libya, that the United States was running weapons from Libya to Syrian rebels. I still to this day somewhat dispute that notion, however, the bigger takeaway from the movie is the White House and State Department resolve to wean the U.S. military power from the global landscape and to install misguided diplomatic efforts in its place not only in Libya but several dozen countries across the globe.

For decades, the United States has been the leader in the world, and rightly so to maintain as much equilibrium as possible, often deploying in order, diplomatic efforts, CIA efforts and finally military efforts. Once Barack Obama made the case in the April 2009 famous Cairo speech, the forecast was clear that he was going to even out the power and positions of nations in the world with particular emphasis on securing Muslim based nations as protected and promoted states.

The last real offensive military operation with any kind of ‘win’ was Libya to remove Muammar Gaddafi from power. Since, we have seen the rise of al Qaeda, Khorasan, Islamic State and the Taliban, where rules of engagement have been so feeble the death tolls rise and the refugee numbers are staggering. This demonstrates that when there is a mission, strategy and resolve to an objective, it can be achieved.

13 Hours proved Libya was in complete chaos for quite some time prior to the attack on September 11, 2012. There had been countless terror attempts, growing militant factions and assassination attempts leading up to that fateful day. Was going back in to Libya to complete the task of establishing a real and functional government beyond the scope of attention and resolve by the State Department and the White House?

I would argue, the unspoken objective of Barack Obama is to no longer demonstrate the power of the United States including military might, but rather to have diplomatic achievements that are only gained by allowing the other side to completely prevail as is the case with Iran.

One of the jobs of the Global Response Staff is to protect people and interests by deploying all assets near and far, calculating responses, time, personnel and approvals. Such was not the case in Libya and in countless other countries during that entire week in September. Many locations had protests and attacks on U.S. posts.

The movie demonstrated that movement of U.S. personnel in Libya was by all foreign contractors or borrowed assets. This places the safety and security of people at risk from the start. No lessons were learned or heeded or laws followed from previous historical attacks.

In March of 2015, there was a growing terror condition in Yemen by the Iranian back Houthis. Yemen was a very large CIA operation there to address AQAP, al Qaeda in the Arabian Peninsula. Moving into April, the United States under John Kerry at the State Department once again failed to respond and upwards of 5000 were at risk, their fate unknown had to fend for themselves. Global Response Staff teams or the military exfil FEST teams or the QRF, Quick Reaction Force were not deployed at the behest of the State Department. Thankfully, India provided the larger portion of the rescue operations.

The military does not leave anyone behind and neither does  any human being with a shred of benevolence. The exceptions are Barack, Hillary and John. America and Americans fate is damned by this trio. Of this, there is no dispute.

By the way, leaving Benghazi, a borrowed oil company aircraft was used for the first flight out and a Libyan transport plane was use for the last flight out, carrying 4 dead Americans. Still no Americans as the lights went out in Benghazi.

Leaders will consider emergency measures to reintroduce internal borders at meeting on Monday, as France warns the entire European project is in ‘very grave danger’

TelegraphUK: The Schengen system of free movement could be suspended for two years under emergency measures to be discussed by European ministers on Monday, as the French Prime Minister warned the crisis could bring down the entire European Union.

Manuel Valls said that the “very idea of Europe” will be torn apart until the flows of migrants expected to surge in spring are turned away.

On Monday, interior ministers from the EU will meet in Amsterdam to discuss emergency measures to allow states to reintroduce national border controls for two years.

The powers are allowed under the Schengen rules, but would amount to an unprecedented abandonment of the 30-year old agreement that allows passport-free travel across 26 states.

The measure could be brought in from May, when a six-month period of passport checks introduced by Germany expires. The European Commission would have to agree that there are “persistent serious deficiencies” in the Schengen zone’s external border to activate it.

“This possibility exists, it is there and the Commission is prepared to use it if need be,” said Natasha Bertaud, a spokesman for Jean-Claude Juncker.

Greece has been blamed by states for failing to identify and register hundreds of thousands of people flowing over its borders.

Other states that have introduced emergency controls are Sweden, Austria, France, Denmark and Norway, which is not in the EU but is in Schengen.

“We’re not currently in that situation,” Ms Bertaud added. “But interior ministers will on Monday in Amsterdam have the opportunity to discuss and it’s on the agenda what steps should be taken or will need to be taken once we near the end of the maximum period in May.”

Theresa May, the British Home Secretary, will attend the meeting.

In a further blow, Mr Valls said that France would keep its state of emergency, which has included border checks, until the Islamic State of Iraq and Levant network is destroyed.

“It is a total and global war that we are facing with terrorism,” he said.

He warned that without proper border controls to turn away refugees, the 60-year old European project could disintegrate.

“It’s Europe that could die, not the Schengen area. If Europe can’t protect its own borders, it’s the very idea of Europe that could be thrown into doubt. It could disappear, of course – the European project, not Europe itself, not our values, but the concept we have of Europe, that the founding fathers had of Europe.

“Yes, that is in very grave danger. That’s why you need border guards, border controls on the external borders of the European Union.”

He said Europe must tell refugees that they cannot expect to reach Europe.

“We cannot say or accept that all refugees can be welcomed in Europe,”

“Germany is faced with a major challenge. We need to help Germany. But the first message we need to send now is with the greatest of firmness is to say that we will not welcome all the refugees in Europe. Because a message that says come, you will be welcome, provokes major shifts,” he told the BBC.

Viktor Orban, Hungary’s Prime Minister, said that a fence should be erected on the Macedonian and Bulgarian borders with Greece to curb the inflow of migrants into Europe.

Stefan Lofven, the Swedish Prime Minister, Mark Rutte, the Dutch Prime Minister, and Donald Tusk, the president of the European Council, have each in the past week said that leaders have until March to save the Schengen zone.

Jean-Claude Juncker has warned that is the Schengen zone dies then the euro and the single market could follow.

The Schengen Agreement

What is it?

Austria announced on Wednesday that it planned to limit the number of people allowed to apply for asylum to 1.5 percent of its population over the next four years, or 37,500.

The move piles more pressure on Angela Merkel, who is facing intense demands from her conservative allies to follow suit.

EU border agency Frontex said on Friday some 108,000 migrants arrived in December in Greece.

That compares to 150,000 arrivals in November and puts the total for Greece and Italy at 1.04 million in 2015, or five times as many as in 2014, Frontex said.

Crossings have slowed due to the cold weather, and are expected to surge when the spring returns.

DHS is Not Deporting Visa Overstays

The numbers are staggering but just for the time period of 2015, 482,000 are residing in the United States illegally. This number is clearly worse than those numbers coming in from the southern border.

DHS admits it’s not deporting most visa overstays

WashingtonExaminer: A pair of Department of Homeland Security officials told the Senate Wednesday that the government does not search for most of the people who overstay their temporary visas, a day after DHS said that nearly 500,000 people were still in the U.S. after having overstayed their visas last year.

“I didn’t mean to imply that we’re actually out monitoring them,” Craig Healy, an assistant director at U.S. Immigration and Customs Enforcement, told Sen. Jeff Sessions, R-Ala., during Senate Judiciary subcommittee panel. Healy said that they review the universe of people who overstayed their visas and “prioritize” the deportation of people who went on to commit other crimes.

Their exchange came at the outset of a hearing on the federal government’s failure to implement a biometric system to track entries into and exits from the country, as required by a 2004 law. A Customs and Border Patrol official said the program couldn’t be implemented without causing “gridlock” at U.S. airports, a response that failed to allay bipartisan concern that the lack of this system is an ongoing national security threat.

“The biometric exit system is still not off the ground and that is unfortunate, very unfortunate, because it is a matter of national security,” New York Senator Chuck Schumer, the Democratic leader-in-waiting, said during the hearing.

John Wagner, deputy assistant commissioner of field operations for U.S. Customs and Border Patrol, said the program couldn’t be implemented without causing two-hour delays when boarding airplanes. “It’s the placement of the technology and how you collect it to ensure that the person actually departed the United States,” Wagner said. “There’s no zone to do that.”

These answers frustrated Democratic lawmakers who otherwise disagree with Sessions and other immigration hawks the issue of border security and deportations. “It’s hard for me to envision that we can’t figure out where to get a space to do this at an airport or seaport,” said Senator Al Franken, D-Minn. “If you can’t solve it in 11 or 12 years, how can we know it will ever be solved?”

DHS’s report saying hundreds of thousands of people remained in the United States after having overstayed their visas drew complaints from both parties, but Sessions in particular.

“That is a population of individuals that is larger than any city in Iowa, New Hampshire, or South Carolina,” Sessions said. Healy replied that about 3,000 of the people who had overstayed their visas were under investigation, a statistic Sessions cited to argue that President Obama’s team has made no effort to implement the system or to deport people who overstay their visas, as long as those people “keep their nose clean” and do nothing to draw the attention of law enforcement or counterterrorism officials.

He said the lack of a biometric exit system was part of a broader failure by the Obama administration to implement federal immigration law.

“Our executive branch is on strike against the will of the American people,” Sessions said. “Simply put, there is no border at all if we don’t enforce our visa rules.”

Administration eases visa rules for travelers visiting terror hotspots

FNC: The Obama administration on Thursday eased visa rules for certain European travelers who have visited terror hotspots in the Middle East and Africa, triggering a backlash from congressional lawmakers who sought the restrictions for security reasons.

Moments after the announcement, two key Republicans declared the administration is “blatantly breaking the law” – a law that President Obama signed – by implementing the changes.

“This is not a difference of opinion over statutory interpretation, it is a clear contradiction of the law and the agreement we reached with the White House,” House Homeland Security Committee Chairman Michael McCaul, R-Texas, and Rep. Candice Miller, R-Mich., author of the bill, said in a statement.

The revised requirements announced Thursday pertain to changes passed by Congress in the Visa Waiver Program.

Lawmakers had sought new restrictions to tighten up the program – which allows visa-free travel for residents of eligible countries — in order to prevent Europeans who have joined ISIS from entering the United States. Under the newly passed Visa Waiver Improvement and Terrorist Travel Prevention Act of 2015, nationals of Iraq, Iran, Syria and Sudan as well as other travelers who have visited those countries since Mar. 1, 2011 now must apply for a visa in order to travel to the U.S.

The administration implemented those changes Thursday — but with some changes of its own.

Under the revised requirements, some Europeans who have traveled to those four countries in the last five years may still be allowed to travel to the United States without obtaining a visa if they meet certain criteria.

The administration announced it will use its waiver authority — granted to it in the legislation — to give waivers to travelers who traveled to the terror hotspots as journalists, for work with humanitarian agencies or on behalf of international organizations, regional organizations and sub-national governments on official duty.

Further, an additional waiver was announced for people who have traveled to Iran “for legitimate business-related purposes” since the conclusion of the Iran nuclear deal in July. The administration offers waivers for individuals who have traveled to Iraq for business as well.

Republicans reacted angrily to the waivers, saying the Obama administration had exploited the limited authority and has compromised national security.

“President Obama and his administration’s decision to abuse their limited waiver authority and allow scores of people who have traveled to or are dual nationals of countries like Iraq and Syria flies in the face of reason and congressional intent,” House Judiciary Committee Chairman Bob Goodlatte, R-Va., said in a statement.

“The Obama Administration is essentially rewriting the law by blowing wide open a small window of discretion that Congress gave it for law enforcement and national security reasons,” Goodlatte said.

Under the visa program itself, citizens of 38 countries, mostly in Europe, are generally allowed to travel to the United States without applying for a visa. But they still have to submit biographical information to the Electronic System for Travel Authorization, or ESTA.

The Homeland Security Department said waivers for some ESTA applicants will be granted on a “case-by-case” basis. Those travelers who are denied visa-free travel can still apply for visa through a U.S. embassy in their home country.

The new restrictions had previously been criticized by the Iranian government which suggested the U.S. might be violating the nuclear deal by penalizing legitimate business travel to the country.

Snapshot: U.S. Terror Report

Last year saw the deadliest Islamist jihad attacks in America since 9/11 and in Europe since 2004, according to the January Terror Threat Snapshot released by House Homeland Security Committee Chairman Michael McCaul (R-Texas).

“The heinous ISIS-linked attack on a policeman in Philadelphia [earlier this month] is a grim reminder of the Islamist terror threat we face today,” McCaul said in releasing this month’s terror snapshot. “ISIS and al Qaeda terrorists are expanding their networks and carving out sanctuaries abroad, while their supporters and operatives have been plotting terror attacks in the West.”

McCaul said Obama’s “strategy to defeat ISIS and other Islamist extremists … is out of touch with reality …”

According to the Snapshot, “Islamist terrorists have been attempting to infiltrate the United States as authorities have uncovered jihadists who were resettled in America through the refugee resettlement program. Two refugees from Iraq resettled in the US were recently arrested on terror-related charges linked to ISIS.”

Additionally, the Snapshot stated, “The United States faces an unprecedented terror threat level at home due to the continued failure to destroy ISIS. Law enforcement authorities have arrested nearly 80 individuals in ISIS-related cases in the United States since 2014 – 62 in 2015 alone. There have been 21 ISIS-linked plots to launch attacks in the homeland. Over 80 percent of the post-9/11 homegrown Islamist extremist cases in the United States have occurred or been disrupted since 2009.”

Islamist terrorists returning to the West from Syria are also “a surging threat,” the snapshot added, noting legislation recently signed into law “will enhance the security of the Visa Waiver Program in order to prevent terrorists from entering the United States.”

• January 7: Sacramento, California-based Islamist extremist Aws Mohammed Younis al Jayab was arrested after lying to authorities about traveling to Syria and fighting alongside terrorist organizations between November 2013 and January 2014. Al Jayab, an Iraqi refugee of Palestinian descent who was resettled in the U.S. from Syria in October 2012, communicated his intention to join terror organizations in Syria over social media. He said he had joined the ranks of Ansar al Islam, a foreign terrorist organization and had communications with an ISIS supporter.

• January 6: Houston, Texas-based ISIS supporter Omar Faraj Saeed al Hardan was arrested for attempting to support ISIS. Hardan, an Iraqi refugee of Palestinian descent who was resettled in the U.S. from Iraq in November 2009, lied to authorities regarding his automatic machine gun training and had associated with ISIS since 2014 and with al Qaeda’s Syrian affiliate Jabhat al Nusra in 2013 and 2014.

• December 30: Rochester, New York-based ISIS supporter Emanuel Lutchman planned to attack a restaurant on New Year’s Eve before being arrested. Lutchman said he received direction from an ISIS operative overseas and also expressed his desire to travel to join ISIS. He recorded a video pledging allegiance to ISIS leader Abu Bakr al Baghdadi and claiming responsibility for the planned attack.

• December 17: Harrisburg, Pennsylvania-based ISIS supporter Jalil Ibn Ameer Aziz was arrested for advocating for violence against Americans through social media and facilitating the travel of ISIS recruits overseas. Aziz was storing high-capacity weapon magazines and ammunition in his residence. He used at least 57 Twitter accounts in support of ISIS’s messaging and reposted a list of the names and personal information of 100 American service members with the intent of inciting attacks against them.

 

• December 11: Edgewood, Maryland-based ISIS supporter Mohamed Elshinawy was arrested after communicating electronically with ISIS operatives based overseas and accepting funds he believed were from ISIS for the purpose of launching an attack inside the United States. Elshinawy pledged allegiance to ISIS leader al Baghdadi in February 2015 and received $8,700 he believed was sent from ISIS operatives through Western Union and PayPal.

• December 11: Minneapolis, Minnesota-based ISIS supporter Khaalid Adam Abdulkadir was arrested when he threatened law enforcement authorities after the FBI publically announced the arrest of ISIS recruit Abdirizak Warsame near Minnesota. Abdulkadir had previously communicated with at least two other ISIS-linked recruiters and former Minnesota-area residents.

• December 9: Eagan, Minnesota-based ISIS supporter Abdirizak Mohamed Warsame was arrested after plotting to join ISIS overseas and facilitating the travel of other individuals in a broader ISIS recruitment network operating from Minnesota. The network began watching Islamist extremist propaganda in 2014 after which it began plotting to send members to join ISIS overseas.

• December 2: Two ISIS-linked terrorists, U.S.-born Syed Rizwan Farook and Pakistani national Tashfeen Malik, attacked a holiday party for local government workers at the Inland Regional Center in San Bernardino, California, killing 14 people. Farook’s friend, Enrique Marquez Jr., was later arrested for purchasing the rifles used in the attack and for conspiring with Farook to plot an attack in 2011-2012. The attackers posted a pledge of allegiance to ISIS’s leader on Facebook.

ISIS TERROR ATTACK PLOTS AGAINST THE WEST

ISIS dramatically expanded its war with a concerted campaign to target the West in 2015.
