Iran Reneges On Nuclear Deal  

“Adoption Day”–the day participants would start the process of implementing their JCPOA commitments – was set for October 18. On that day, therefore, the US and the EU began preparatory measures for lifting the multiple sanctions that have crippled Iran’s economy since they were first imposed in 2005. Only three days later, on October 21, Ayatollah Khamenei published a letter of guidelines to Iranian President Hassan Rouhani about the JCPOA.

This letter, the Middle East Media Research Institute (MEMRI) reported, was posted on Khamenei’s website in Persian, tweeted from his Twitter account, posted on his Facebook page in English, and published in English by the Iran Broadcasting Authority. In this document, clearly the definitive statement of the conditions under which Iran would be willing to execute the JCPOA, Iran’s Supreme Leader sets nine new and unilateral conditions that fundamentally change what was agreed on July 14. In short, he has virtually declared the JCPOA a dead letter.

What are these nine new conditions?

First Khamenei demands that sanctions are lifted fully, not suspended, before Iran takes steps to meet its obligations under the agreement. In addition he asserts that any endorsement by the West of the “snapback” option (the reintroduction of sanctions should Iran fail to meet the terms of the agreement) will be considered “non-compliance with the JCPOA”.

Secondly: Any future sanctions against Iran for whatever reason, including terrorism or human rights violations, will “constitute a violation of the JCPOA,” and a reason for Iran to stop executing the agreement.

Thirdly: Under the JCPOA Iran is obligated to start changing the function of its nuclear reactor at Arak and shipping out most of its stockpile of enriched uranium. In his letter Khamenei declares that Iran will not carry out these actions until after the International Atomic Energy Agency (IAEA) closes its dossier on Iran, targeted for December 15. But the IAEA will not be able to report about Iran meeting its obligations regarding the Arak reactor and shipping out its enriched uranium by the target date, because Iran is not going to do so by then. In short, the JCPOA has been thwarted from the very start.

Fourth: Iran will change the purpose of the Arak reactor only after there is a signed agreement on an “alternative plan” and “sufficient guarantee” that it will be implemented. In other words, Iran intends to postpone fulfilling its obligations under the JCPOA regarding the Arak reactor to some unknown future date.

Fifth: Iran intends to postpone indefinitely the date set by the JCPOA for shipping out its enriched uranium to another country in exchange for yellowcake. Moreover Khamenei is demanding that Iran receive in exchange for the enriched uranium not raw uranium as per the JCPOA, but instead uranium that has been enriched, albeit to a lower level than the uranium it ships out.

Sixth: Khamenei instructs President Rouhani, while reducing Iran’s ability to enrich uranium under the JCPOA, immediately to expand Iran’s ability to enrich uranium on a 15-year long-term plan for 190,000 centrifuges. In short, he is nullifying the declared goal of the JCPOA, which is to reduce Iran’s nuclear enrichment capabilities.

Seventh: The Iranian Atomic Energy Organization must ensure continued nuclear research and development, in its various dimensions, so that in eight years’ time, Iran will not be lacking in enrichment technology.

Eighth: Khamenei declares that Iran must be involved in resolving queries about the JCPOA – a recipe for unending dispute and the ability to paralyze the execution of the agreement.

Ninth: A new committee tasked with monitoring the execution of the agreement is to be established – nominally to obviate any attempt by the US or the West to cheat, but in effect, a mechanism for creating perpetual obstacles to carrying out the agreement.

So far world opinion has turned a blind eye to Khamenei’s virtual rejection of the nuclear agreement. The US and the EU are proceeding enthusiastically with the first stages of dismantling their multiple sanctions regimes. Government officials and businessmen from around the globe are making a beeline for Tehran, eager to share in the vast commercial opportunities they see awaiting.

The nuclear agreement is the basis for Iran’s re-entry into the comity of nations, and Khamenei seems to be setting the stage for a battle of wills between Iran and the West. Will the West’s desire to come to terms with Iran outweigh Iran’s determination to give away less than their president has actually signed up to? Will the West delay the lifting of sanctions? Who will blink first?

Rouhani says U.S.-Iran ties could be restored but U.S. must apologize

ROME (Reuters) – The nuclear deal reached between world powers and Iran could lead to better relations between Tehran and Washington if the United States apologized for past behavior, Iranian President Hassan Rouhani was quoted as saying on Thursday.

The pragmatist president, who championed the July 14 deal, has pushed for closer engagement with the West since his 2013 landslide election win.

But Iran’s top authority, Supreme Leader Ayatollah Ali Khamenei, has continued to rule out normalizing ties with the “Great Satan”, as he routinely calls the United States.

In an interview with Italy’s Corriere della Sera newspaper, Rouhani suggested that the United States and Iran could open embassies in each other’s capitals after decades of mutual hostility, but said Washington should apologize, without going into further detail.

“One day these embassies will re-open but what counts is behavior and the Americans hold the key to this,” Rouhani told the newspaper ahead of a trip to Italy this weekend, his first to a European capital.

“If they modify their policies, correct errors committed in these 37 years and apologize to the Iranian people, the situation will change and good things can happen.”

Iran and Washington severed ties shortly after the 1979 Islamic revolution when radical students seized the U.S. embassy in Tehran and held 52 Americans hostage for over a year.

Relations came under further pressure in the last decade over Iran’s nuclear ambitions.

Under the nuclear deal reached in July, Iran will curb its nuclear program in exchange for an easing of sanctions on its economy. Tehran denied Western suspicions it wanted to develop an atomic bomb.

Khamenei, who has the final say on all state matters, gave his conditional approval to the deal with six world powers including the United States, but has warned against allowing any U.S. political or economic influence on Iran.

Rouhani said Washington would have to fulfill its part in the nuclear accord for relations to improve. The United States approved conditional sanctions waivers for Iran, though these will not take effect until Tehran has complied with the nuclear accord.

“The way this agreement is applied can have an impact on the future,” Rouhani said in the interview.

“If it is well applied it can lay the foundation for fewer tensions with the United States, creating the conditions to open a new era. But if the Americans don’t respect their part of the nuclear accord, then surely our relationship will remain as it has been in the past,” he said.

Rouhani is due to see the Italian prime minister and business leaders during his Nov. 14-15 visit to Rome and will also hold talks with Pope Francis.

He will then fly to Paris for talks on Nov. 16-17.

VA Scheduler Whistleblower/Confessions

FNC report and video here. Veterans Affairs Secretary Robert McDonald has made a point of giving out his personal contact information, to show how accessible he is as he works to overhaul the embattled agency.

But the bid backfired Thursday, after he urged one famous veteran dealing with poor treatment to contact him. When “Fox & Friends” tried his number, they reached his voicemail — and got a message to call back later as his voicemail was “full.”

– Bay Area veterans say they’re still facing excessive wait times for benefits and health care. The VA Inspector General found 307,000 veterans may have died waiting for access to the VA health care system.

Veterans who do get enrolled say significant delays for medical service persist.

“They gave me an appointment six months down the road, and then called to say they had to cancel,” said Winter Haven veteran Keith Brown. “It can be a year before you get the actual appointment.”

That conflicts with information provided by the Department of Veterans Affairs, which showing wait times have improved following the VA scandal of 2014.

Nick McSwain says there may be a reason for that. He said when he worked as a VA scheduler through the beginning of 2015, he was told to disregard patients’ desired dates for appointment, then note the actual scheduled date as the ‘desired’ date — thereby showing no delay based on what veterans requested.

“It says ‘What is the desired date’ (in the system) and instead of using that date, we use the appointment we actually give them so it shows no gap,” said McSwain.

He also claims veterans who complained had to wait even longer for future appointments.

“Vets who should have been seen top priority were passed over because of the way providers feel about this guy. They’d say ‘I hate this guy’ or ‘he’s annoying,” said McSwain, w

ho also noted that consults for specialty health care piled up when he worked in a scheduling center. “There have been times when stacks of consults disappeared.”

A spokeswoman for U.S. Rep. Gus Bilirakis said his district offices have opened 314 VA-related cases since January 2, 2015, pertaining to both benefits and health care.

FOX 13 asked the Department of Veterans Affairs to respond to a range of questions and issues raised by Thompson, Brown, and other veterans. The department answered our questions and provided data to show the VA is making progress and notable improvements since the national VA scandal broke in 2014.

The VA provided the following snapshot of data through November 1, 2015:

  1. Between June 1, 2014, and November 1, 2015, the electronic wait list (EWL) went from 56,271 appointments to 46,146, a 17.99 percent reduction.
  2. VHA created 2.5 million authorizations for Veterans to receive care in the private sector from October 29, 2014 through October 28, 2015. This represents a 3 percent increase in authorizations when compared to the same period in 2013/2014.

A spokeswoman at the James Haley Veterans Hospital and clinics also sent us an email including the following statement and response to our questions.

The James A. Haley Veterans Hospital answered our questions as follows:

What are the current average wait times for primary care, specialty care and mental health care?

Our wait-times are published every two weeks, the same as other VA facilities and current and historical wait time and access data can be reviewed at: http://www.va.gov/health/access-audit.asp

Currently James A. Haley Veterans’ Hospital and Clinics average wait times are 1.33 days for Primary Care, 6.33 days for Specialty Care (just as in the public sector, length can vary significantly by Specialty Clinics) and 3.66 days for Mental Health.

JAHVH has more than 90,000 unique patients and we schedule between 4,000-5,000 appointments daily in all areas of our medical facilities and at our outpatient clinics and receive more than 46,000 consults per month in FY 15.

Every new consult is reviewed by a clinical provider as part of the triage process to determine the clinical urgency of the request. Patients are seen as soon as possible based on clinical review – the more acute the need – the faster the patient is scheduled for an appointment on average.
Do lengthy hold times by phone to schedule a doctor or specialist persist? 

Our average wait time to answer the phone is 49 seconds in FY 15 (the national goal is less than 30 seconds) and our abandonment rate is 3.9% (the national goal is less than 5%), but depending on the location within the medical center a person is calling, hold times and speed to answer the phones can vary. We recognize this can be one of the biggest areas of dissatisfaction with patients and the medical center has established a workgroup that is working to improve telephone access to all areas. Additionally, patients are encouraged to use secure messaging if possible to consult with their health care providers.

Are there safeguards to prevent veterans seeking medical appointments from being left on hold indefinitely?  If so, can they be worked around?

The phone system has different features throughout the medical center based on the volume of calls and staffing level of clinic areas.  One tool we use in high volume areas is the Automatic Call Distributor (ACD) lines. These lines will automatically roll over to the next available operator after a certain length of time. Also some clinics are piloting the use a call back feature for patients who choose not to wait on hold.  Secure messaging is always another option that patients can use to communicate with their providers, and if a patient has difficulty reaching a provider, we encourage patients to reach out to the Service Liaisons or Patient Advocates Office.

Do veterans in the Tampa Bay area continue to encounter lengthy delays to see a doctor or specialist once appointments are booked?

Again, wait times vary based on the type of care, but our average wait times range from 1.33 to 6.33 days. If a patient is unable to be seen at our facilities within 30 days of the clinically indicated/preferred date, that patient is offered care through the Choice program and is then eligible to receive care in the community. Wait times in the community can also be lengthy based on the availability of certain specialty care required and can be a longer wait than VA care in some cases.

We are continuously and proactively reviewing our high demand specialty areas to help further increase capacity and efficiencies. For example, we do “Super Saturday Clinics” in both Ortho and GI to reduce some of the current patient wait times and are actively working to fill vacant provider positions. JAHVH hiring emphasis has been on Patient Aligned Care Teams (Primary Care) and high demand Specialty Care Services to increase access, including Orthopedics, GI, Ophthalmology and Radiology and we’ve filled over 100 new FTE positions under VACAA funding including providers, nurses and support positions.

During FY 14, JAHVH activated more than 300,000 square feet of new space, which opened up space for specialty care to expand. JAHVH increased specialty care spaces from 34 to 84 exam rooms for a net increase of about 150%, including an additional:

  • 18 in Ortho
  • 14 in GI
  • 17 in Neurology to open in first quarter of FY16

Additionally, extended hours and weekend appointments are offered at Tampa, New Port Richey Outpatient Clinic, and Lakeland Community Based Outpatient Clinic.

How are consults (enabling veterans to seek specialty care) organized and accounted for to prevent them from getting lost?

Consults are managed and organized in compliance with the National Consult Management Business Rules. All notes are kept in individual patient records.

JAHVH also has a Consult Management Committee (CMC) and designated consult managers within each service who are responsible for ensuring the consults do not get lost. The CMC is a standing medical center-level committee designated to receive, monitor, analyze and address all aspects of consult management to meet the facility’s mission and commitment to timeliness of care, provide support to enhance communication of Veterans’ needs, and outcome of treatment.  As part of these activities, the CMC functions to coordinate the assessment, implementation, and management of consults and related VISTA structures with all other appropriate entities and reports these activities as appropriate. The CMC identifies opportunities for improvement, and recommends corrective action plans.

Have schedulers within the VA health care system ever been told by VA management to disregard regulations in any way?

Schedulers are trained to follow all scheduling guidelines. Refresher training is provided to schedulers when scheduling errors are identified through observation, periodic and scheduled audits, etc. There was refresher scheduling training completed for all staff who have scheduling options conducted between July – September 2015. Any staff that did not complete this training had their scheduling access removed.

Specifically, have schedulers been told to disregard ‘desired’ appointment dates, to avoid gaps between ‘desired’ dates and scheduled dates?  

Employees are fully and regularly trained and should never disregard regulations when making an appointment for patients. JAHVH is audited by both internal and external organizations to review and ensure data and appointment policies and procedures are followed correctly.  JAHVH executive leadership does not advocate or condone any data manipulation or scheduling irregularities. Should an instance of irregularity be identified, it would be reviewed and corrective action would be taken as necessary.

Have veterans who complain about poor service or delays been adversely affected (with longer waits) as a result of their complaints?

We encourage anyone with a specific concern to contact the hospital’s team of Patient Advocacy Specialists that work as liaisons for the Director’s Office and are on staff specifically to assist Veterans with any issues or concerns they may have. Additionally, we have Service Liaisons, who field incoming calls from Veterans and either answer their questions or route the individuals to the appropriate office to handle their concerns. JAHVH follows national scheduling guidelines and reviews all appointment and consult requests to ensure they are scheduled timely according to the patients’ clinical needs and condition.

For veterans who complain they are unable to utilize their choice cards as they would like, how does VA respond?

JAHVH follows the CHOICE Program rules based on the VACAA law that state a Veteran is eligible for non-VA care in the community if he/she lives more than 40 miles from a VA Facility (to include CBOCs even if they don’t offer the specialty) or if based on long wait times (patients that have an appointment scheduled greater than 30 days from when the clinically indicated/preferred date). Veterans may file an “excessive burden” appeal. Additionally, on July 31, 2015, the President signed Public Law 114-41, the Surface Transportation and Veterans Health Care Choice Improvement Act of 2015. Title IV, the VA Budget and Choice Improvement Act, makes several changes to the Veterans Choice Program. We are currently awaiting implementation guidance of these changes. VA Paid out $142 Million in Bonuses in 2014

VA gave 156,000 employees $142 million in bonuses in 2014

WashingtonExaminer: The Department of Veterans Affairs VA shelled out more than $142 million in performance bonuses in 2014, the same year that the VA’s healthcare scandal exploded and revealed the VA was systematically denying veterans access to health care.

The average individual payout was over $900 for the thousands of employees. A total of 156,000 VA workers qualified for bonuses as a result of being rated them “fully successful” or higher at carrying out their responsibilities last year, including officials at delay-prone hospitals. But those ratings were later found to be inflated, as the vast majority of workers were getting rated highly enough to get a bonus.

More than 325 were compensated with $5,000 to $13,000 in year-end bonuses, according to data given to the Washington Examiner by the House Committee on Veterans’ Affairs.

Before he resigned, VA Secretary Eric Shinseki said he’d stop bonuses at the troubled agency. But in the summer of 2014, Congress approved legislation allowing the agency to hand out up to $360 million in bonuses each year.

House Veterans’ Affairs Committee Chairman Jeff Miller, R-Fla., said the bonus awards are part of a “disturbing trend” of rewarding workers even when they haven’t earned it.

“VA loves to tout its bonus program as a way to attract and retain the best and brightest employees,” Miller wrote. “Unfortunately, often times the employees VA rewards with thousands in taxpayer-funded bonuses are not the type of people the department should be interested in attracting or retaining.”

In the current Congress, the House has passed a number of bills that include language to rein in the department until better results are obtained, including recouping bonuses paid to employees, changing the cap on bonuses from $360 million to $300 million, and limiting senior-level bonuses to $2 million per year.

The Senate Committee on Veterans’ Affairs is currently considering three of the House-approved bills.

“Rewarding failure only breeds more failure. Until VA leaders learn this important lesson and make a commitment to supporting real accountability at the department, efforts to reform VA are doomed to fail,” said Miller.

NASHVILLE, Tenn. — In a Fox 17 Waste Watch investigation, government findings finally confirm reports you’ve seen on Fox 17 News about US veterans dying while waiting for healthcare through the VA.

To make matters worse, the number of those who have died while waiting for this care is six times higher than originally estimated.
Even with an increase in funding, the VA’s Office of Inspector General is calling for an overhaul.
Midstate veteran David Jones says he’s among the more than 800,000 veterans whose file is stuck in a “pending” status.
Jones says, “People are trying to get well, they’re trying to get benefits and it’s next to impossible.”

Jones is unable to get the care he needs because his application to the Veterans Health Administration’s Health Eligibility Center is backlogged in its Enrollment System.

This VA Office of Inspector General report confirms that not all of these applicants are for veterans actively seeking enrollment in VA health care.
It says the applications of these veterans have been “inactive” for years and more than 300,000 veterans died during this time.
Congressman Diane Black (R-TN, 6th District) says, “I was surprised.  I thought we’d see a different number than what we did.”

Since reports of this VA issue initially surfaced about two years ago, the President has named a new head of the agency.  Congress has approved for VA Secretary Robert McDonald to fire employees not doing their jobs.

The agency’s data system has changed and it’s received a 5.5 percent budget increase with the President allocating more than $168-billion dollars to the VA in his 2016 budget. Fox 17 News has also found this OIG report calls out VA employees for incorrectly marking unprocessed applications as “completed” and may have deleted more than 10-thousand transactions from its system.

The government’s Human Resources Office and General Council are now determining if administrative action should be taken against any senior officials in the Veterans Health Administration or Office of Information and Technology.

Russian TV stations broadcast secret nuclear torpedo plans

Document was left out in view when NTV and Channel One filmed Vladimir Putin meeting with military officials in Sochi

The Kremlin has admitted that Russian television accidentally showed secret plans for a nuclear torpedo system on air. Two Kremlin-controlled channels, NTV and Channel One, showed a military official looking at a confidential document containing drawings and details of a weapons system called Status-6, designed by Rubin, a nuclear submarine construction company based in St Petersburg. The nuclear torpedoes, to be fired by submarines, would create “zones of extensive radioactive contamination making them unsuitable for military or economic activity for a long period”, says the document, which is clearly visible in the footage for several seconds.

The images were filmed during a meeting of President Vladimir Putin with military officials in the Black Sea city of Sochi on Monday.

The footage was aired on Tuesday and later deleted by the channels, but several websites still published screenshots from it.

“It’s true some secret data got into the shot, therefore it was subsequently deleted,” Putin’s spokesman, Dmitry Peskov, told journalists.

“In future we will undoubtedly take preventive measures so this does not happen again.”

It remained unclear how the images ended up being broadcast on the tightly controlled channels.

The document was shown at a meeting where Putin warned that “Russia will take necessary retaliatory measures to strengthen the potential of our strategic nuclear forces”

*** The project is called “Ocean Multipurpose System ‘Status-6′” with the TsKB MT Rubin design bureau listed as the lead developer (Rubin is the design bureau that built virtually all submarines that are currently in service). A brief paragraph describes the mission of the proposed system as follows:

Damaging the important components of the adversary’s economy in a coastal area and inflicting unacceptable damage to a country’s territory by creating areas of wide radioactive contamination that would be unsuitable for military, economic, or other activity for long periods of time.

The picture that follows shows that at the core of the weapon system is an underwater autonomous drone (“self-propelled underwater craft” or SPA), which could be delivered by one of the two submarines – Project 09852 or Project 09851. For some reason, the drone is shown as attached to the bottom of the 09852 submarine, but not to the 09851 [UPDATE: Colleagues tell me that the vehicle attached to the 09582 sub is not the drone pictured later on the slide]. The text is hard to read, but it appears that Project 09852 submarine will carry four drones and Project 09852 – either 3 or 6. Given that 09852 is a smaller submarine (its displacement is shown as “10000 t” vs. what looks like a larger number for 09852), it’s probably 3. It certainly does not look like “1”, although “2” is a possibility. [UPDATE: I am told that a better quality photo shows that the number is “6”.]

Interestingly, these two submarines are relatively recent projects. Project 09852 was laid down at Sevmash in December 2012. It is said to use the hull of the Belgorod submarine of the Project 949A/Oscar II class. The first Project 09851 submarine, Khabarovsk, was laid down in July 2014. (Project 09851 was also mentioned in the R&D known as Kalitka-SMP.)

Ignoring Abuse of Afghan Children Is a Strategic Failure

More than morality at stake

The Afghan police commander laughed at them. But Capt. Dan Quinn and Sgt. First Class Charles Martland didn’t find anything funny about the situation.

Throughout their deployment, members of the U.S. Army Special Forces detachment under Quinn’s command became troubled by the behavior of the Afghan Local Police forces they were supposed to be mentoring. The team reported several incidents — one involving a police commander who raped a teenage girl — to their commanders and to Afghan authorities.

In each case there was either no consequences or a slap on the wrist.

But late in the deployment, a woman came to the soldiers’ base. She told them an ALP commander chained her son to a bed and raped him, then beat her. She begged the Green Berets for justice.

When Quinn and Martland confronted the ALP commander, he readily admitted to doing it and even joked about it. Furious, Quinn and Martland shoved him to the ground and allegedly beat him.

Not long after, Army brass reprimanded both soldiers and sent them home. Quinn left the Army, while Martland became an Army scuba instructor in Florida where he continued to receive high marks. He previously received two Bronze Stars for valor.

But the incident remained in his files, and the Army decided it was enough to warrant kicking Martland out through its force reduction program. He defended his actions in a January 2011 letter to the Army Human Resources Command, stating he and Quinn “felt that morally we could no longer stand by and allow our ALPs to commit atrocities.”

On Oct. 28 the Department of Defense’s Inspector General office released an announcement that it will be investigating cases of Afghan officials abusing children, and whether American officials could have — or should have — done more to stop it.

The investigation comes after a series of allegations made headlines, as several American military personnel face discipline for either whistleblowing or taking unauthorized action against predators.

The most high profile case has been Martland’s. Nov. 1 was to be his last day on active duty, but the Army is currently reviewing his case on appeal after a media storm and pressure from congressmen, including fellow Afghanistan war veteran Rep. Duncan Hunter of California.

While the decorated special operations warrior may very be vindicated, the case remains part of a troubling chapter of America’s longest war.

Many American officials have defended the military’s hands off approach to Afghan forces committing rape, insisting that it’s a cultural issue and a matter for Afghan law. But many of the Afghan police tasked with enforcing that law are in fact guilty of much of the abuse. And they do so while receiving American training, weapons and funds.

Several experts and special operations veterans War Is Boring spoke to argued that allowing rape isn’t merely a moral failure, it’s a strategic one that undermines America’s mission in Afghanistan — and shows a fundamental misunderstanding of Afghan culture.

A dishonorable act

Forms of pederasty involving relationships between influential men and young boys aren’t new and they’ve never been limited to central Asia. “You see this going all the way back to Greece and Rome,” explained anthropologist Thomas Barfield, an Afghan culture specialist at Boston University.

But he said war and weak rule of law have allowed it and other forms of abuse to thrive.

In Afghanistan, the practice of “bacha bazi” — meaning “boy play” — is typically associated with rich and powerful Afghan men, some of whom use it as a means to flaunt their wealth and power. One form of bacha bazi involves concerts in which teenagers and boys dance for older men who then sexually abuse them.

“You cannot try to impose American values and American norms onto the Afghan culture because they’re completely different,” Col. Steve Johnson told the Tacoma News Tribune in August. “We can report and we can encourage them. We do not have any power or the ability to use our hands to compel them to be what we see as morally better.”

But while bacha bazi has existed in Afghanistan for generations, Barfield argues that calling it a “cultural norm” is misleading. He said that while powerful men may take part, it’s not something that Afghan culture celebrates.

“If you’re talking to regular people they wouldn’t find it acceptable,” he said. “It violates Islamic law and cultural norms.”

Many special operations veterans who’ve spent time living among Afghans have come to the same conclusion. “When you get to the point where you have to admit that this is something ‘powerful men’ do, you’re automatically admitting this isn’t normal,” said one veteran.

Barfield recalled a murder he learned about during one of his visits as a researcher in Afghanistan. Afghans told him about how an enraged man had killed his brother after learning he was participating in bacha bazi. “The story of these two brothers was considered a family tragedy,” he said. “Afghans have a very strong conception of honor and this is a stain on that honor.”

Barfield said that while some elites will take part in or watch these acts, most would deny taking part. “It’s something people would rarely admit to,” Barfield explained. “It’s actually used as a pretty common insult, to accuse powerful people of bacha bazi.”

Bacha bazi comes in various forms. During his field research, Barfield interviewed what he called “professional bachas,” typically young adults and teenagers who make a living in a seedy underworld often discussed in whispers.

“If you want to go to see a dancing boy concert they’re usually held out in the middle of nowhere,” Barfield explained.

“But in this case what we’re actually talking about is kidnapping,” Barfield said of the scandal that’s rocked the Pentagon.

Decades of war in Afghanistan have given rise to a much more predatory class of pederasts. Barfield explained that for some powerful Afghans, bacha bazi can be a way of demonstrating their might and asserting that rules don’t apply to them.

“[These people are often] warlords and commanders, so these are people who are used to making their own rules,” he said.

Rape and other crimes were hallmarks of both the Soviet occupation of the 1980s and subsequent Afghan Civil War of the 1990s. When the Taliban seized power, its puritanical worldview demanded an end to vices. One of the group’s top priorities was putting an end to bacha bazi. They executed many of the worst offenders, sometimes publicly.

One Special Forces veteran explained in a conversation with War Is Boring that many Taliban fighters were also once raped by older men, and that for some it was huge reason why they joined the movement. “When the Taliban came to power they put a stop to this shit,” he said.

The militants considered it part of their campaign against immorality, particularly a crackdown on gays and lesbians. However, men who partake in bacha bazi don’t typically consider themselves gay. “Most of these men would consider themselves straight,” Barfield explained.

But the Taliban’s moral campaign soon extended much further. The Taliban banned music, women’s education, kite flying, most sports and destroyed anything the group deemed “un-Islamic.” The goodwill the Taliban earned among Afghans from its crackdown on pedophiles and rapists quickly faded as the group’s repressive puritanical rule took shape.

Many welcomed American forces as they ousted the Taliban after 9/11. Schools reopened and kites returned to the skies.

But American troops and operatives often had to work closely a motley collection of Northern Alliance fighters, Pashtun rebels and other armed groups. The Americans soon learned that not all were as trustworthy as others. And some of them had dark pasts that would soon come to shape Afghanistan’s future.

A symptom of corruption

Afghan children have long been central to the narrative of the war in Afghanistan. When the Taliban was ousted in 2001, American officials touted the return of Afghan children to schools. Educating the next generation was a major emphasis — the children of today will be the leaders of Afghanistan tomorrow.

But with new opportunities came the return of old problems. Former warlords became military commanders, police officers and politicians. “It reflects that the Americans didn’t know who they were dealing with,” Barfield explained. “They unwittingly allowed some of these bad actors to regain power.”

Barfield said that provincial politicians and warlords would often exaggerate their ties to the Americans and present themselves as stronger than they actually were.

“They’d say ‘do as I say or I’ll send the Americans to burn down your village,’” Barfield explained. “The Afghans didn’t necessarily have the information to know that they were lying … the Americans of course had no idea.”

Corruption has been endemic in the new Afghanistan with aid money constantly going missing or wasted on lavish projects. The quality of Afghan security forces has been inconsistent. Soldiers and police officers often do not receive regular paychecks and must depend on shoddy equipment, a consequence of corruption. There’s also problems with abuse and misconduct.

Some Afghan troops and police have been known to engage in extortion, smuggling and kidnapping. In many cases that’s included the kidnapping and sexual abuse of children — sometimes even on U.S. bases. And that was far from a secret before Martland’s case blew up.

In 2012, a 17-year-old Afghan boy kept on a U.S. Marine base by police commander Sarwan Jan got ahold of a weapon and killed three Marines in the base gym. Prior to the killings, junior Marines — including some of those killed — had expressed concerns about Jan. The commander had a long history of corruption and child abuse.

A year later Vice documentary This Is What Winning Looks Like portrayed U.S. Marines candidly telling filmmaker Ben Anderson that the Afghan police they work with regularly kidnap and rape children — and frequently murder them.

The Marines expressed frustration that nobody seemed to take the problem seriously despite their repeated reports.

Johnson, who was a battalion commander with the 1st Special Forces Group at the time Martland and Quinn beat the Afghan policeman, has defended the decision to discipline the two. Johnson asserted the soldiers beat the Afghan commander nearly to death.

However, other Afghans — including a well regarded interpreter — allegedly told officials the injuries were minor and that the commander was walking around the next day.

It’s hard to know exactly what happened. The case was never put through the military criminal justice system and the Afghan police commander later died in a Taliban ambush.

The crux of the arguments against Martland and Quinn is that they acted rashly and potentially could have damaged relations with the Afghans cops — and possibly drive them to join the militants.

One former Green Beret told War Is Boring that the actions of the Afghan police would reflect directly on the advisers. After all, the ALP is trained, paid and equipped by the Americans. According to the veteran, the team had to show the Afghan villagers that they too cared about honor, otherwise villagers might start supporting the Taliban.

“When [Martland] beat the shit out of that police commander, that’s actually something a lot of Afghans would really respect,” Barfield said. “That’s a form of justice that Afghans understand very well.”

Playing by the rules

“I think this really reflects the state of law and order in Afghanistan as a whole right now,” Barfield said. “After 30 years of war, it’s allowed these sorts of bad actors to thrive.”

In the years since Martland and Quinn left Afghanistan, the military has put more and more emphasis on the ALP. These militia-turned-police played a huge role in the security of Kunduz … as well as its recent fall to Taliban militants.

These militias were responsible for protecting the people of Kunduz and maintaining order. But were also notorious for extortion, theft, assault and of course … bacha bazi. The Taliban took advantage of resentment among the locals to reestablish a foothold in the area before delivering a humiliating blow to Afghan forces this summer.

 

During an interview with War Is Boring about his book The Tigers and The Taliban in 2013, Danish army veteran Lars Ulslev Johannesen explained how corruption and instability drove many Afghans to sympathize with the militants, even those who disliked their repressive ideology.

“Predictability is important,” Johannesen said. “They know the Taliban rules, and prefer them even though they do not like them, because they know what they need to do in order to survive.”

Since the Taliban fell, there have indeed been strides in education — and Afghan artists and activists have far more freedom than they’ve known in decades. But when police kidnap and rape the children with impunity, it fundamentally undermines the rule of law and the legitimacy of Afghanistan’s fledgling government.

For many of the soldiers who fought there, despite the battles they won, corruption and sexual abuse undermines America’s purpose and reason for being in the country. “We’re not being outfought,” one veteran bitterly remarked during research for this story. “We’re being outgoverned.”
