From the DoJ’s Deputy Attorney General as published by Washington Post: ‘More than 35,000 inmates are seeking clemency, but a complicated review process has slowed the Obama administration’s initiative. In February, Obama commuted the sentences of 22 drug offenders, the largest batch of prisoners to be granted early release under his administration and the first group of inmates who applied after the new criteria were set.

“Certainly, I don’t think I can ever be accused of being soft on crime,” Yates said. “But we need to be using the limited resources we have to ensure that we are truly doing justice and that the sentences we’re meting out are just and proportional to the crimes that we’re charging.”

We’re not the Department of Prosecutions or even the Department of Public Safety,” Yates said. “We are the Department of Justice.”

Enter the Clemency Project and Barack Obama having it both ways with a lottery system.

“Obama said that he had “revamped” the Office of the Pardon Attorney, and promised to be “more aggressive” with his clemency powers.

But memos from the White House obtained by USA TODAY revealed a different story. President Obama would “very rarely, if ever grant pardons for major drug offenses and guns crimes,” said one memo, and during his first 18-months in office, the President knowingly and deliberately allowed the Bush Administration’s clemency policies to remain in effect.”

Clemency Project 2014 – a working group composed of lawyers and advocates including the Federal Defenders, the American Civil Liberties Union, Families Against Mandatory Minimums, the American Bar Association, and the National Association of Criminal Defense Lawyers, as well as individuals active within those organizations – launched in January after Deputy Attorney General James Cole asked the legal profession to provide pro bono (free) assistance to federal prisoners who would likely have received a shorter sentenced if they had been sentenced today. Clemency Project 2014 members collaborate to recruit and train attorneys on how to screen for prisoners who meet the criteria listed below and assist prisoners who meet the criteria to find lawyers to represent them. Clemency Project 2014 lawyers provide assistance free of charge to applicants. Anyone asking you to pay is not working with Clemency Project 2014.

WASHINGTON – Deputy Attorney General James Cole announced today a new set of criteria the Justice Department and White House will use when considering clemency petitions from federal prisoners. The new criteria will help the Justice Department identify federal prisoners who, if sentenced today under current sentencing laws and policies, would likely have received a substantially lower sentence.

“Our federal sentencing laws have shattered families and wasted millions of dollars,” said Vanita Gupta, ACLU deputy legal director. “Too many people—particularly people of color—have been locked up for far too long for nonviolent offenses. The President now has a momentous opportunity to correct these injustices in individual cases. If we’re ever going to see truly systemic and smart reform of the federal criminal justice, however, we need Congress to step up and pass the Smarter Sentencing Act.”​

Clemency Project 2014, a working group composed of the Federal Defenders, the American Civil Liberties Union, Families Against Mandatory Minimums, the American Bar Association, and National Association of Criminal Defense Lawyers, as well as individuals active within those organizations, wholeheartedly supports Cole’s announcement and the Justice Department’s plans to restore the integrity of the clemency process.

According to the DOJ indictment, Huang Zhenyu was hired between 2006 and 2009 or later to do programming work for one of the companies (referred to as “SOE-2” in the indictment). Huang was allegedly tasked with constructing a “secret” database to store intelligence about the iron and steel industry, as well as information about US companies.

“Chinese firms hired the same PLA Unit where the defendants worked to provide information technology services,” according to the indictment, which the US Department of Justice unsealed Monday. “For example, one SOE involved in trade litigation against some of the American victims herein hired the Unit, and one of the co-conspirators charged herein, to hold a ‘secret’ database to hold corporate ‘intelligence.'”

The for-hire database project sheds some light on the operations of China’s most prolific hacking unit, Unit 61398 of the Third Department of China’s People’s Liberation Army (also known as APT1), where the alleged hackers work. US Attorney General Eric Holder announced an unprecedented move Monday: The Justice Department had indicted the five men with the military unit for allegedly hacking and stealing trade secrets of major American steel, solar energy, and other manufacturing companies, including Alcoa, Allegheny Technologies Inc., SolarWorld AG, Westinghouse Electric, and US Steel, as well as the United Steel Workers Union.

It has never been a secret, it has only been a topic debated with no resolutions behind closed doors. China has a database on Americans and is filling it with higher details, growing their intelligence on everything America.

Hacked in the U.S.A.: China’s Not-So-Hidden Infiltration Op

From Bloomberg: The vast cyber-attack in Washington began with, of all things, travel reservations.

More than two years ago, troves of personal data were stolen from U.S. travel companies. Hackers subsequently made off with health records at big insurance companies and infiltrated federal computers where they stole personnel records on 21.5 million people — in what apparently is the largest such theft of U.S. government records in history.

Those individual attacks, once believed to be unconnected, now appear to be part of a coordinated campaign by Chinese hackers to collect sensitive details on key people that went on far longer — and burrowed far deeper — than initially thought.

 

But time and again, U.S. authorities missed clues connecting one incident to the next. Interviews with federal investigators and cybersecurity experts paint a troubling portrait of what many are calling a serious failure of U.S. intelligence agencies to spot the pattern or warn potential victims. Moreover, the problems in Washington add new urgency to calls for vigilance in the private sector.

In revealing the scope of stolen government data on Thursday, Obama administration officials declined to identify a perpetrator. Investigators say the Chinese government was almost certainly behind the effort, an allegation China has vehemently denied.

‘Facebook of Intelligence’

Some investigators suspect the attacks were part of a sweeping campaign to create a database on Americans that could be used to obtain commercial and government secrets.

“China is building the Facebook of human intelligence capabilities,” said Adam Meyers, vice president of intelligence for cybersecurity company CrowdStrike Inc. “This appears to be a real maturity in the way they are using cyber to enable broader intelligence goals.”

The most serious breach of records occurred at the U.S. Office of Personnel Management, where records for every person given a government background check for the past 15 years may have been compromised. The head of the government personnel office, Katherine Archuleta, resigned Friday as lawmakers demanded to know what went wrong.

The campaign began in early 2013 with the travel records, said Laura Galante, manager of threat intelligence for FireEye Inc., a private security company that has been investigating the cyber-attacks.

Stockpiling Records

By mid-2014, it became clear that the hackers were stockpiling health records, Social Security numbers and other personal information on Americans -– a departure from the country’s traditional espionage operations focusing on the theft of military and civilian technology.

“There was a clear and apparent shift,” said Jordan Berry, an analyst at FireEye.

Recognition came too late for many of the victims. Vendors of security devices say health-care companies are spending tens of millions of dollars this year to upgrade their computer systems but much of the data is already gone.

U.S. intelligence agencies were collecting information on the theft of personal data but failed to understand the scope and potential damage from the aggressive Chinese operation, according to one person familiar with the government assessment of what went wrong.

In the last two years, much of the attention of U.S. national security agencies was focused on defending against cyber-attacks aimed at disrupting critical infrastructure like power grids.

 

Pope Transforms Papacy to Political Pulpit

Pope Francis has applied his authority and the Catholic Church altering Catholic doctrine and message to high stakes politics. He has solicited high stakes policy wonks on the matter of Climate Change and his team is mobilized.

His shepherds, his Bishops, his Cardinals will install United Nations approved language and actions into all sermons, visits and religious message.

What a shame, there was such hope for renaissance of the Vatican yet it was short lived.

Note: Naomi Klein is a social activist who is against corporate capitalism, and has the DNA of peace activism and her grandparents were communists. She admits to being labeled a red-diaper baby where social justice and racial equality is her continued bent. Climate change is her mission. Klein is an acolyte of Howard Zinn and Noam Chomsky proven by the third book she authored titled The Shock Doctrine.

Hence, she successfully gained the attention of Pope Francis.

Social activist ‘surprised but delighted’ to join top cardinal in high-level environment conference at the Vatican

She is one of the world’s most high-profile social activists and a ferocious critic of 21st-century capitalism. He is one of the pope’s most senior aides and a professor of climate change economics. But this week the secular radical will join forces with the Catholic cardinal in the latest move by Pope Francis to shift the debate on global warming.

Naomi Klein and Cardinal Peter Turkson are to lead a high-level conference on the environment, bringing together churchmen, scientists and activists to debate climate change action. Klein, who campaigns for an overhaul of the global financial system to tackle climate change, told the Observer she was surprised but delighted to receive the invitation from Turkson’s office.

“The fact that they invited me indicates they’re not backing down from the fight. A lot of people have patted the pope on the head, but said he’s wrong on the economics. I think he’s right on the economics,” she said, referring to Pope Francis’s recent publication of an encyclical on the environment.

Release of the document earlier this month thrust the pontiff to the centre of the global debate on climate change, as he berated politicians for creating a system that serves wealthy countries at the expense of the poorest.

Activists and religious leaders will gather in Rome on Sunday, marching through the Eternal City before the Vatican welcomes campaigners to the conference, which will focus on the UN’s impending climate change summit.

Protesters have chosen the French embassy as their starting point – a Renaissance palace famed for its beautiful frescoes, but more significantly a symbol of the United Nations climate change conference, which will be hosted by Paris this December.

Nearly 500 years since Galileo was found guilty of heresy, the Holy See is leading the rallying cry for the world to wake up and listen to scientists on climate change. Multi-faith leaders will walk alongside scientists and campaigners, hailing from organisations including Greenpeace and Oxfam Italy, marching to the Vatican to celebrate the pope’s tough stance on environmental issues.

The imminent arrival of Klein within the Vatican walls has raised some eyebrows, but the involvement of lay people in church discussions is not without precedent.

Ban Ki-moon, the UN secretary-general, delivered the keynote address at a Vatican summit in April on climate change and poverty. Anticipating the encyclical, he said he was depending on the pope’s “moral voice and moral leadership” to speed up action.

When it came to the presentation of the document itself, the pontiff picked a five-strong panel, including a Rome school teacher and a leading scientist. Hans Joachim Schellnhuber, who heads the Potsdam Institute for Climate Impact Research, used the time to give churchmen a lesson in climate science.

The pope has upset some conservatives for drawing people from outside the clergy into the heart of the debate, while critics have also argued the Catholic church should not be involved in an issue that should be left to presidents and policy-makers.

But Klein said the pope’s position as a “moral voice” in the world – and leader of 1.2 billion Catholics – gives him the unique ability to unite campaigners fighting for a common goal. “The holistic view of the encyclical should be a catalyst to bring together the twin economic and climate crises, instead of treating them separately,” she said.

Much of the pope’s discourse focuses on the need to give developing countries a greater voice in climate change negotiations, a view that sits uncomfortably among some in developed nations. “There are a lot of people who are having a lot of trouble in realising there is a voice with such global authority from the global south. That’s why we’re getting this condescending view, of ‘leave the economics to us’,” said Klein.

She views the rise of Francis as an environmental campaigner as marking a welcome shift not only in the international sphere but also at the Holy See: “We’re seeing the power base within the Vatican shift, with a Ghanaian cardinal [Turkson] and an Argentine pope. They’re doing something very brave.”

While the upcoming conference is centred on the pope’s encyclical, delegates will also be looking ahead to decisive international meetings this year. Before the Paris talks comes a UN summit, where states are due to commit to sustainable development goals, which will inevitably affect the environment.

The pope will fly into New York on the first day of the meeting and address the UN general assembly, reinforcing his message and emboldening countries worst affected by climate change.

For Klein, the papal visit will mark a much-needed change in the way negotiators discuss the environment. “There’s a way in which UN discourse sanitises the extent to which this is a moral crisis,” she said. “It cries out for a moral voice.”

Why disregard of law is America’s greatest threat

Citizens may ask why they should obey the rules when illegals go scot-free

Barbarians at the gate usually don’t bring down once-successful civilizations. Nor does climate change. Even mass epidemics like the plague that decimated sixth-century Byzantium do not necessarily destroy a culture.

Far more dangerous are institutionalized corruption, a lack of transparency and creeping neglect of existing laws. All the German euros in the world will not save Greece if Greeks continue to dodge taxes, featherbed government and see corruption as a business model.

Even obeying so-called minor laws counts. It is no coincidence that a country where drivers routinely flout traffic laws and throw trash out the window is also a country that cooks its books and lies to its creditors. Everything from littering to speeding seems negotiable in Athens in a way not true of Munich, Zurich or London.

Mexico is a naturally richer country than Greece. It is blessed with oil, precious minerals, fertile soils, long coastlines and warm weather. Hundreds of thousands of Mexican citizens should not be voting with their feet to reject their homeland for the United States.

But Mexico also continues to be a mess because police expect bribes, property rights are iffy, and government works only for those who pay kickbacks. The result is that only north, not south, of the U.S.-Mexico border can people expect upward mobility, clean water, adequate public safety and reliable power.

In much of the Middle East and Africa, tribalism and bribery, not meritocracy, determine who gets hired and fired, wins or loses a contract, or receives or goes without public services.

Americans, too, should worry about these age-old symptoms of internal decay.

The frightening thing about disgraced Internal Revenue Service bureaucrat Lois Lerner’s knowledge of selective audits of groups on the basis of their politics is not just that she seemed to ignore it, but that she seemingly assumed no one would find out, or perhaps even mind. And she may well have been right. So far, no one at the IRS has shown much remorse for corrupting an honor-based system of tax compliance.

Illegal immigration has been a prominent subject in the news lately, between Donald Trump’s politically incorrect, imprecise and crass stereotyping of illegal immigrants and the shocking murder of a young San Francisco woman gratuitously gunned down in public by a Mexican citizen who had been convicted of seven felonies in the United States and had been deported five times. But the subject of illegal immigration is, above all, a matter of law enforcement.

Ultimately, no nation can continue to thrive if its government refuses to enforce its own laws. Liberal “sanctuary cities” such as San Francisco choose to ignore immigration laws. Imagine the outcry if a town in Utah or Montana arbitrarily declared that federal affirmative action or gay marriage laws were null and void within its municipal borders.

Once an immigrant has successfully broken the law by entering and residing in the United States illegally, there is little incentive for him to obey other laws. Increasing percentages of unnaturalized immigrants are not showing up for their immigration hearings — and those percentages are higher still for foreign nationals who have been charged with crimes.

The general public wonders why some are selectively exempt from following the law, but others are not. If federal immigration law does not apply to foreign nationals, why should building codes, zoning laws or traffic statutes apply to U.S. citizens?

Consider the immigration activists’ argument that immigration authorities should focus only on known felons and not those who only broke immigration law. This is akin to arguing that the IRS shouldn’t worry about whether everyday Americans pay their income taxes and should enforce the tax laws only against those with past instances of tax avoidance.

But why single out the poor and foreign-born? Presidential hopeful Hillary Rodham Clinton once pocketed a $100,000 cattle-futures profit from a $1,000 investment, with help from an insider crony. A group of economists calculated the odds of such an unlikely return at one in 31 trillion. Mrs. Clinton then trumped that windfall by failing to fully pay taxes on her commodities profits, only addressing that oversight years later.

Why did Mrs. Clinton, during her tenure as secretary of state, snub government protocols by using a private email account and a private server, and then permanently deleting any emails she felt were not government-related? Mrs. Clinton long ago concluded that laws in her case were to be negotiated, not obeyed.

President Obama called for higher taxes on the wealthy. But before doing so, could he at least have asked his frequent adviser on racial matters, Al Sharpton, to pay millions in back taxes and penalties?

Might the government ask that its own employees pay the more than $3 billion in collective federal back taxes they owe, since they expect other taxpayers to keep paying their salaries?

Civilizations unwind insidiously not with a loud, explosive bang, but with a lawless whimper.

 

 

Sanctuary Cities, Don’t Ask Don’t Tell

Let’s get real, this is a funded ‘shut up’ program.

We often refer to them as illegal immigrants and are slammed for using the word illegal, but the Department of Justice itself uses the term ‘criminal’ when referring to foreign nationals in America unlawfully.

Imagine a system that complies with the 9/11 Commission recommendations that every lawmaker in Washington signed on to such that ICE or Border Patrol would follow the law and confusion and collusion would not permeate across governments that invite deadly disasters.

The most recent deadly event of an illegal foreign national in America occurred in San Francisco, a sanctuary city, one of hundreds in America.  The man, now arrested gave his confession and reason for being in the United States and killing the woman. Barack Obama himself advised the California governor to advance and approved the Trust Act. It essentially eliminates the ‘hold requests in jails.

In 2012, Barack Obama changed the rules for immigration causing confusion, legal warfare and fast but hidden changes in enforcing law.

Last year there was the largest insurgency of illegals coming across our southern border in many years and that cause a chain reaction across several government agencies including the Center for Disease Control.

CDC Official Calls Obama Worst President, Amateur, Marxist After Influx of Illegal Alien Minors

Following the influx of illegal immigrant minors from Central America, an official at the federal agency charged with protecting public health describes Barack Obama as “the worst pres we have ever had,” an “amateur” and “Marxist,” according to internal emails obtained by Judicial Watch.

JW got the records as part of an investigation into the Center for Disease Control’s (CDC) activation of an Emergency Operations Center (EOC) to deal with the barrage of illegal alien minors last summer. Tens of thousands of Central Americans came into the United States through the Mexican border and contagious diseases—many considered to be eradicated in the U.S.—became a tremendous concern. The CDC, which operates under the Department of Health and Human Services (HHS), responded by opening an emergency facility designed to monitor and coordinate response activities to eminent public health threats.

Yet, when it comes to destinations of illegals, they head to sanctuary cities and while some locations are overflowing, new locations are added, creating a country within a country, all paid for by the Department of Justice.

The program is in fact called STATE CRIMINAL ASSISTANCE PROGRAM and what is even more terrifying up to 850 U.S. cities received grant money for the program, far beyond the number of cities officials will admit to. In 2010, $400 million dollars in grants was provided under this program.

The real costs of SCAAP is not adequate to support state and local governments resulting in several cities working to get out of the program due to the financial burdens.

While the blame game is now underway to point fingers at mayors, or sheriffs or ICE, the real blame goes directly to the Department of Justice, contrary to what the White House reveals as republicans are at fault for not passing immigration reform.
