The Other College Tuition Scandal, Give up Custody

Parents give up legal custody…what? Well, perhaps there is a silver lining in this…no more student loan debt….

Parents are giving up legal guardianship of their children during their junior or senior year in high school to someone else — a friend, aunt, cousin or grandparent. The guardianship status then allows the students to declare themselves financially independent of their families so they can qualify for federal, state and university aid, a ProPublica Illinois investigation found.

“It’s a scam,” said Andy Borst, director of undergraduate admissions at the University of Illinois at Urbana-Champaign. “Wealthy families are manipulating the financial aid process to be eligible for financial aid they would not be otherwise eligible for. They are taking away opportunities from families that really need it.”

While ProPublica Illinois uncovered this practice in north suburban Lake County, where almost four dozen such guardianships were filed in the past 18 months, similar petitions have been filed in at least five other counties and the practice may be happening throughout the country. ProPublica Illinois is still investigating.

Borst said he first became suspicious when a high school counselor from an affluent Chicago suburb called him about a year ago to ask why a particular student had been invited to an orientation program for low-income students. Borst checked the student’s financial aid application and saw she had obtained a legal guardian, making her eligible to qualify for financial aid independently.

The University of Illinois has since identified 14 applicants who did the same: three who just completed their freshman year and 11 who plan to enroll this fall, Borst said.

ProPublica Illinois found more than 40 guardianship cases fitting this profile filed between January 2018 and June 2019 in the Chicago suburbs of Lake County alone.

Nearly all the cases identified by ProPublica Illinois were handled by one of two law firms: The Rogers Law Group in Deerfield, which handled most of them, and the Kabbe Law Group in Naperville. The only case filed by a different firm involved the family of Rick Rogers, of the Rogers Law Group.

Georgieva runs a Lincolnshire-based college consulting company, Destination College, which offers “strategies to lower tuition expenses.” The company’s logo is a graduation cap with dollar bills spilling out of it. In video testimonials, clients praise the company for saving them money.

She is tied to at least several of the families, as well as to Rogers, the attorney, who is also featured in the video.

The description for the company’s “premier” services includes a “College Financial Plan, Using Income and Asset Shifting Strategies to Increase Your Financial and Merit Aid and Lower Out of Pocket Tuition Expenses.”

Lesley Stahl vs. Betsy DeVos on Education

US Parents Involved in Education, USPIE, explains more details about the Federal government in public education. Common Core is still alive in many states, while in others, it just has a different name. Furthermore, not only is the Federal government at the state level working on regulating homeschooling, there is the whole matter of zero privacy for students. This is a terrifying condition.

Wonder if Lesley Stahl reads The Hill and this significant report or if Betsy DeVos has read it.

Education Secretary Betsy DeVos’ recent interview with Lesley Stahl on “60 Minutes” caused quite a bit of backlash from critics.

DS: As my colleague Jonathan Butcher has written, “60 Minutes” ignored many of the facts about the state of education in America. Response to the interview drew quite a bit of criticism of DeVos and her policy solutions.

Perhaps one of the most pivotal moments came when she suggested that the United States’ heavy federal investment in education has not yielded any results. Stahl hit back, asserting that school performance has been on the rise.

But the latest government data show otherwise. According to the recently released 2017 National Assessment of Educational Progress, also known as the nation’s “report card,” we now have more evidence that DeVos was correct.

In fact, recent scores show virtually no improvement over 2015 scores. Eighth-grade reading saw a single point improvement over 2015 scores (10 points is considered equivalent to a grade level), while all other categories saw no improvement.

These lackluster results come on the heels of declines on the 2015 assessment, suggesting the beginning of a trend in the wrong direction for academic outcomes.

Indeed, Stahl’s claim that the state of public schools has gotten better simply doesn’t hold up to the data. It fact, DeVos is entirely correct to point out that public school outcomes have not meaningfully improved, and that our nation’s heavy federal intervention in K-12 education has failed to help the problem.

As Heritage Foundation education fellow Lindsey Burke writes:

Forty-nine out of 50 states were stagnant on the 2017 report card, and achievement gaps persist. Historically, federal education spending has been appropriated to close gaps, yet this spending—more than $2 trillion in inflation-adjusted spending at the federal level alone since 1965—has utterly failed to achieve that goal.

Increasing federal intervention over the past half-century, and the resulting burden of complying with federal programs, rules, and regulations, have created a parasitic relationship with federal education programs and states, and is straining the time and resources of local schools.

Indeed, for decades, Washington has poured billions of dollars into the public education system under the assumption that more federal spending will close achievement caps and improve the academic outcomes of students. With mounting evidence that more federal spending is not the answer, it may be time to consider other policy approaches.

DeVos is correct to suggest school choice as a solution to lackluster school performance. Parents who cannot afford to send their child to a school that is the right fit deserve to have options. As DeVos told Stahl:

Any family that has the economic means and the power to make choices is doing so for their children. Families that don’t have the power, that can’t decide, ‘I’m gonna move from this apartment in downtown whatever to the suburb where I think the school is gonna be better for my child.’ If they don’t have that choice, and they are assigned to that school, they are stuck there. I am fighting for the parents who don’t have those choices. We need all parents to have those choices.

In light of recent evidence from the nation’s report card, “60 Minutes” and other school choice critics should consider that DeVos was correct in her framing of problems facing the nation’s schools and is on the right track with possible solutions—namely, that empowering parents is the right approach to improving American education.

What do you Know About H.R. 4174?

Conservatives declared that CommonCore was bad for education and needed to be terminated in all states. Sadly, in many cases it was just renamed.

Are you fine with social engineering in education? Are you good with peer to peer teaching? Are you aware of the changing syllabus and use of textbooks? Did you know the data on you, the family and the student is being collected from pre-Kindergarten all the way through entry into the workforce? How about medical and personal data being sold to third parties for a profit without your knowledge or approval? Can you opt out? Nope.

It appears the government believes it now owns individual military data, IRS data, Census data, and all citizen-level data in any federal agency. One exception to this ownership assumption exists in medical data, which as defined and protected by HIPPA, belongs to the patient (or their guardian).  However, medical data is “leaking” into other data streams such as education data. This blurs the lines for HIPPA protections and allows medical information to become part of the integrated, government data system.

USPIE’s primary mission is to close the U.S. Department of Education, repeal all federal education mandates and return control of education to parents and local communities.  Our efforts include protecting the privacy of student data from government-directed collection, integration, and sharing. So, what is P20W anyway?

Data governance is both an organizational process and a structure. It establishes
responsibility for data, organizing program area/agency staff to collaboratively and
continuously improve data quality through the systematic creation and enforcement of
policies, roles, responsibilities, and procedures. Data governance is necessary for creating
clear roles and responsibilities for each member of the project team.
This document relates to P-20W or interagency data governance rather than K12 or
intra-agency data governance. While there are many similarities in structure and process
between inter- and intra-agency data governance, there are key differences. For example,
among the various P-20W agencies, there are varying security requirements, data uses,
reporting requirements, and timelines. There is also a different, broader research agenda at
the P-20W level. (See Figures 1 and 2, next page, for depictions of single agency vs. P-20W
data governance structures.)
When data governance is effectively established, the quality of data collected, reported, and
used by state and local education agencies (SEAs and LEAs)—as well as early childhood,
postsecondary, and other agencies (Department of Labor, Department of Health, etc.)—
is enhanced; staff burden is reduced; and communication, collaboration, and relationships
with the various agencies, information technology (IT) staff, and program areas are
improved.

Scrolling through this document as it relates to P20W is actually terrifying. The Department of Education is collaborating with the Department of Labor and the entire student education history and behavior is recorded including that of the family of record and will stay in a data system for decades…
Simply scroll here to see how the data is collected, where it originates and how it is used and shared. People in government and private enterprise that don’t know you are scoring behavior and psychology of the entire family structure but is that a good thing? Hardly.

H.R. 4174 was introduced by Congressman Paul Ryan and co-sponsored by Trey Gowdy. Yep…believe it. What is really shady is the legislation was not in the education committee…

DoJ Investigates Harvard U, How About other Universities?

We keep hearing the term ‘class warfare’ meaning the population in the United States has been officially divided into groups where the left has applied labels. This essentially translates to breaking down the profiles of people into segmented minority groups such as LGBT, color, religion, culture, country of origin and economic status. Hence the divisions manifest.

College campuses are the incubation hubs for where the defined groups are most notable and Harvard is being investigated by the Department of Justice on the matter of admissions related to exacerbating division and class warfare.

Investigating Harvard is a good start and may provide a model for what is occurring at other universities such as Berkeley, Columbia, Georgetown and hundreds more.

Harvard’s Affirmative Action Program is Now the Subject of a DOJ Investigation

The Trump administration is investigating Harvard University over whether the elite university is favoring particular racial groups in its admissions policies — a probe that critics say is an attack on affirmative action on campus.

The Department of Justice confirmed its investigation, which follows reports that the agency was hiring lawyers to begin a probe into whether Harvard was exercising “intentional race-based discrimination” to pick its student body, the New York Times reported in August.

Supporters of affirmative action, which allows colleges to use race as a factor in their selection process, said such an investigation would undermine educational opportunities for students of color.

“The Department of Justice has launched an unprecedented assault on efforts to promote racial diversity in higher education,” said Kristen Clarke, president and executive director of the Lawyers’ Committee for Civil Rights Under Law, a national watchdog group.

The Justice Department has not outlined which racial groups it believes are being favored at Harvard or, potentially, other universities. But the department’s actions under Attorney General Jeff Sessions are aligning with an argument popular in right-wing circles that affirmative action is reverse discrimination that hurts white students. Critics say the Justice Department investigation is a big by the Trump administration to energize its base.

The Justice Department’s move arrives when for the first time the majority of Harvard’s incoming class was made up of minorities, with 50.8 percent of the Class of 2021 from racial minorities, up from 47.3 percent last year.

“When you think about what the top priorities for the Department of Justice should be at this time when it comes to civil rights, I can’t imagine that chiming in for the first time against affirmative action policies should be at the top of the list,” Austin Evers, executive director of American Oversight, told Newsweek.

Evers’s group had filed a freedom-of-information request that led to the Justice Department revelation that it was indeed investigating Harvard.

Officially, the Justice Department has it was following up on a 2015 federal complaint filed by more than 60 Asian-American associations.

Harvard officials declined to comment on the investigation.

The alleged attack on affirmative action comes after Eric Dreiband, Trump’s pick to lead the Civil Rights Division, once defended the University of North Carolina when it was accused of discriminating against transgender people. Civil rights group protested his nomination to the position.

“The fact that Mr. Dreiband failed to separate himself from or condemn the politically charged investigations into affirmative action policies at colleges and universities makes his nomination even more concerning in light of this new information regarding the Department’s efforts,” Clarke said.

In 2016, the Supreme Court upheld the basic ideals of affirmative action, asserting that race could remain a factor considering a student’s admittance into a university. The court also cautioned universities to continually review their affirmative action programs and suggested that not all programs could stand up against “reverse racism” challenges. Supporters of affirmative action were frustrated that the High Court did not use the case to end all challenges to using race as a factor in selecting students.

Indeed, Harvard’s frustration was apparent in a statement issued to Newsweek with its no comment on Thursday: “To become leaders in our diverse society, students must have the ability to work with people from different backgrounds, life experiences and perspectives,” the school said. “Harvard remains committed to enrolling diverse classes of students. Harvard’s admissions process considers each applicant as a whole person, and we review many factors, consistent with the legal standards established by the U.S. Supreme Court.”

Back in School, But is it Really About Education

Children of all grades are being dropped off by parents, are walking in groups to school or you can find them at bus stops where a parent keeps a watchful eye until that big yellow thing on wheels shows up.

Another year of Federally managed education where school choice is a fragmented option in systems across the country while other counties are teaching CommonCore or International Baccalaureate. Other schools have failing systems with regard to meeting grade standards yet still other locations are just financially broke due to teacher unions like the Illinois system. The debate continues on homeschooling, charter schools, parochial systems, private systems of religious/church bases education centers, as to which is best for independent students and choices.

Overview and Mission Statement

ED’s mission is to promote student achievement and preparation for global competitiveness by fostering educational excellence and ensuring equal access.

ED was created in 1980 by combining offices from several federal agencies. ED’s 4,400 employees and $68 billion budget are dedicated to:

  • Establishing policies on federal financial aid for education, and distributing as well as monitoring those funds.
  • Collecting data on America’s schools and disseminating research.
  • Focusing national attention on key educational issues.
  • Prohibiting discrimination and ensuring equal access to education.

Government agencies are assigned an inspector general to audit those departments for compliance. There is no recent report from the IG except one in 2014 that reviewed financial matters, data compliance and accounting systems.

While performing financial audits is laudable, reviews must be performed on the educators themselves, the student performance and reviews of textbooks and the syllabus. Exactly who is teaching your child or grandchild, what are they teaching and how is it taught?

How many foreign students are in your local system that require countless accommodations including translators? How is the affecting pace and subject delivery?

The chatter regarding education seems to circle around the notion of ‘school choice’ but what is the definition of that term? What is the menu of choices and does that menu have any valuable affect on the students’ quality of education?

Open house is a new school year event where parents or guardians meet the teachers, walk the halls of the building for orientation and talk about the plans for the school year. Sounds wonderful unless tangible answers and compliance are realized. Oh yeah, there are all kinds of fees that need to be paid for ridiculous items including parking, school supply funds, meal tickets, technology usage, medical supplies and library systems to mention a few.

What about school safety and access to non-school related visitors? What about after school activities and class size? Is there really a teacher with certification heading the class or is there some intern or teaching assistant?

Parents and students are in a permission society when it comes to education, meaning can my student participate in an advanced curriculum or is there additional help for reading or algebra?

Schools across the country have been adapting to social pressures rather than just structure and teaching.

Pew Research posted an academic fact sheet in February of 2017 showing in part the following:

One of the biggest cross-national tests is the Programme for International Student Assessment (PISA), which every three years measures reading ability, math and science literacy and other key skills among 15-year-olds in dozens of developed and developing countries. The most recent PISA results, from 2015, placed the U.S. an unimpressive 38th out of 71 countries in math and 24th in science. Among the 35 members of the Organization for Economic Cooperation and Development, which sponsors the PISA initiative, the U.S. ranked 30th in math and 19th in science. Go here for more details.

Quality academics in all grades requires attention by parents and guardians and for that matter all property taxpayers. It is the single most important investment in the future of this great nation and cannot be hijacked by special interest groups, unions or local politicians.
